"Because it might have occurred at the end of her shift on the same day (November 13) that this allegedly occurred? That would be my guess." It would be helpful if Dark or another retailer could tell us if the charges are batched just once a day or what the procedure is. I know in the past when we did do charges from a small machine at the sub-acute facility, it occurs to me each night we had charges we sent a batch as part of our closing process. So while the charge went through at whatever time we ran it through the machine, maybe its not considered official until the batch is completed on the retailer's end? Computers can only do what they've been programmed to do. There's so much bad software out there plus many levels of retailer software I'm not willing to guess as much as others. (Probably the IT and programmer part of me. ) Dark, Cawaiu, Tloony, ready to enlighten us?

I am not a handwriting expert, but I do see very strong similarities of the '$.55' in both receipt totals. I found the 55's to be strikingly different in handwriting. The numbers are more "round" and symmetric in image one (Merchant Copy). The one on the right (Customer Copy) is more of a scrawl.
Also, the receipt on the left is the Merchant Copy (the one with the nasty note scrawled on it).
The one on the right is the Customer Copy. They (one of the diners) could very easily have altered their copy later to show that it included the $18. tip.
Fact is, the note scribbled on the receipt was discriminatory and hateful.
This wait person served in the military - and paid her dues - the money pouring in from strangers is being donated on her behalf to Wounded Warriors - not going into her pocket.
I still feel it was the diners who stiffed her AND left the nasty note.
If they were so against her "lifestyle", they could have asked to be seated a different server's section from the get-go before even ordering their meal.

Here is the thing - the couple has NOTHING to gain from coming forward. Their names weren't mentioned before, so it's not like people were shaming them by name.
The waitress, however, did gain a lot of $$$
so, if for nothing else, I would believe the couple more.
I don't know about others, but I find it VERY hard to trust any story on the internet where people end up collecting donations.

Will have to read up on this- but I can think of no reason for this woman or the restaurant to make up shit- but sure, some co-worker could have written some garbage- but doesn't make up for the tip strike out.
Everyone wants the truth right? So let these people provide the proper proof.
As far as the law- there is no such thing as suing for defamation of a mystery plaintiff. It is put up or shut up- and if I left a tip my ass would be on camera in the face of America that called me a cheapskate.
For now they can post whatever the hell they want- I say prove it- and then go after someone if that is where the truth lies.

Maybe it matters or maybe it doesn't but in the majority of restaurants I have gone to the customer copy is not the one signed or the one with the tip. I could leave $50 and would still get the customer copy with blank lines- I write the tip on my copy so my records are straight.
Or let me clarify- you get two slips when cashing out- merchant copy and customer copy- at the same time. You only return the merchant copy. So unless there is evidence to the contrary the merchant copy is only one that counts.

No one has come forward- everyone knows who the waitress is- so who are these people? I say bring it all out. Only way to find the truth isn't it? My transactions are sent to my merchant processor in real time. I'm not sure if they're batched on their end or processed as they're received. I don't really care as long as my money is in my checking account the next day.
It would take me all of thirty seconds to pull up an old transaction in my POS system and see what happened though. Especially since the receipt with the note on it was posted everywhere. Search for the transaction number on the top, pull up the transaction, and I could see exactly what was charged, what was purchased, and whether there was a tip. Not sure why this case is taking longer than a day for the restaurant to resolve.

I find the handwriting different - but that doesn't mean the customer copy is fake. If someone at the restaurant wrote the comment, then the handwriting would be different. The writing being different doesn't prove something either way. I see no point in debating that.
I also don't find much value in debating the validity of the customer copy because they aren't actually copies. In every restaurant I go to, they bring two copies to the table. My husband always puts the customer one in his pocket and fills out the other one. If he wanted to go back later and write in that he gave them a nine million dollar tip and signed it "The zombie of George Washington, bow down or I'll eat your brain" - he could do that and it would look totally valid.
I also don't see the value in debating the quality of the receipt. That picture of the side-by-side receipts is actually two pictures of other pictures of the receipts, edited to be on the same screen. There is no value in debating shadows because one might have been snapped by the reporters cell phone in a dark alley, and the other was brought to the studio and set up by a professional.
And I agree with WhoisJohnGalt - the anonymous diners didn't have anything to gain by doctoring a bunch of documents and coming forward, so I'm not sure why they would go through the trouble.
I guess we are just debating the amount charged to the Visa. Sure the couple could have doctored it. And I wouldn't be surprised if the restaurant knows exactly what they charged - they are just stalling hoping this will all go away. The "investigation" might be complete - but it is noneya, so we aren't' privy to the conclusion. Or the investigation might be "Who." Maybe they believe that Dana didn't do this, but are about to fire some other a-hole who thought this would be funny.

Not sure why this case is taking longer than a day for the restaurant to resolve. maybe the family that are regulars spend a lot of money there, have been for years and the waitress is new and a general pita to the owner? but because she's militantly gay he's afraid to do anything like fire her? just looking at some possibilities.

The waitress is the person who picks up the adjusted cc bill from the table (with or without an added tip) and enters the adjusted amount on the cc machine. The message left had to be seen by her, at that time, if it was there. I do not see how another employee could have played a "trick" on her. The only way an employee could be involved, is the stub set there for a long time unattended, and someone ran a duplicate copy and posted the note. I do not know if each wait person has their own security code to enter their amounts into the credit card terminal, or if it just an "open to anyone: system.

Your "possibility" is the owner/manager may be afraid to fire her (because as you say she is militantly gay). As for militantly anything, are white, middle aged, Christian men (and women) militant because they have taken offense about something said and complained about it? If so, we have quite a number of 'militant' white, middle aged, Christian men (and women) on these boards. Is being militant about anything you strongly believe in a bad thing?

My guess ìs the bank does not/would not involve its self ìn this matter.

I was thinking the same thing. I rarely fill out my customer copy & what I put on there is absolutely meaningless.
Seems possible. When I leave I just stick the receipt on the table & walk out. I have no idea how long it might sit there sometimes.

So far from what I've heard the answer to both your and my question is no.
ETA: That Daily Mail article states that she will not be returning to her shifts until the investigation is complete.

Whatever actually happened, somebody did something that is just wrong. I don't see one wrong as better than another in this situation. Whether the note was written by the family, the waitress, or another coworker - I see all alternatives as equally repulsive. Vindicating the family just means someone else is a horrible person.

We don't know what happened here. There are conflicting stories, and there is conflicting evidence. The short version: We don't know.
That said, IMO, it's no better to want the couple's story to be true than it is to want the restaurant's story to be true. There's bias on either side and there's ugliness on either side.
