You want to be the test case? You think there isn't a prosecutor in these red states who would arrest a physician in one of these circumstances? If the law is unclear, it is open to interpretation. Catholic hospitals already are ambiguous on this point. I would not trust this situation without a ruling that is enforceable in theses states. I am not going to jail for anyone. People can give all kinds of opinions, but the opinions are not legally enforceable. It all depends on who interprets the law. One of these cases will wind up in court. Article is behind a pay wall.

Doctors not liable even in states with bans www.reuters.com/ Unfortunately, it depends on the state & the hospital. Without divulging personal information, I had emergency surgery years ago when something regarding my female parts went bad. In my case, I would have died without the surgery. DH has a relative in a Southern state that just had a similar problem. But, she has no medical insurance. All the hospital did was stabilize her condition and send her home. I still don't know if she's had her surgery. She IS a mom, and I sincerely hope she survives, but the state she lives in has a reputation of not "giving a darn" when it comes to medical care. So, let's just say I don't have a lot of faith in the Red states to do the right thing. Frankly, I hope the family of the first woman who dies wins a HUGE amount of money in a lawsuit. It won't bring her back, but someone has to pay for indifference...

The attorneys general in these states need to come out, and state unequivocally that if these procedures are done in these specific situations that they are not a crime, and the physicians will not be prosecuted. If they did that, then I would believe that the is little risk. Have s add by of them done so yet?

Unfortunately all laws require interpretation, as do pretty much all medical cases. I don't know what the law says - but a hospital would likely have to prove that the medical need was valid, and within the parameters of the law. It only takes one judge, who has never been a medical provider, to decide that the law didn't cover *this particular case* and the doctor acted inappropriately. If there is a federal law that specifically states etopic pregnancies can and should always be terminated, someone should tell all those dumbass state legislators that are spending so much time insisting that etopic pregnancies should not have an exception to the abortion ban.

Few of them are statewide. Most are local AGs in blue areas I thought they said if you had an abortion and were from a state that prohibited it, the AG saying they won't prosecute is meaningless. They said b/c there is no statute of limitations on murder, all it would take would be an AG that did not agree and they could start prosecuting old cases.

I have a little more faith in humanity tonight. students at Boston University have filled a vending machine in their student union with Plan B. and yes, I recognize I live in the bluest state in the country. The fact that there was no report or dna evidence request is irrelevant. He knows that. You know that. He was basically trying to tell the 10 yo and her family that she wasn’t taped, and used a public forum to do so. I do not think any of this lets him of the hook for his statement

The best part of my long day of driving was driving through a downtown street in Fort Wayne, Indiana and seeing a pro-choice demonstration. All ages and types of people. Men, women, children, Black, white, etc.
I enjoyed giving them the thumbs up as I drove that block and hearing them cheer.

I'm always proud to say I was born and raised in Massachusetts. And I'm proud of B.U.. I'm always proud to say I was born and raised in Idaho and got out when I was old enough to decide for myself where to live. I would still be in Massachusetts if it weren't for the long, cold winters (and job opportunities within my employer's company here in Memphis).

DCF had to have a record of the report once she was seen by s physician, as physicians are mandatory reporters, and a pregnant 10 yo is a situation where you must suspect child abuse. In addition, if teachers knew she was pregnant, they must also report it. Do, all these Republicans who are starting anything to the contrary are horrible human beings. Unless they believe a 10 yo can consent to sex I think like Fox they often refuse to acknowledge that bad things happen on a regular basis. You have to hide or ignore the news IMO to not realize young children are raped and kids younger than 10 get sexually assaulted as well.

The thing that was ridiculous about the argument that seemed to be “I don’t know about it so therefore it must not exist” is that I would think the state attorney general doesn’t get every case in Ohio run through his office. If he did, that would mean that the local people aren’t doing their jobs and they would get bogged down quickly. Jaywalking in Akron? Call the AG. Speeding in Columbus? Call the AG. Burglarizing a store in Dayton? Call the AG. The fact that this guy (the AG) thinks something doesn’t exist just because he doesn’t know about it, is scary. Someone that ignorant and not self aware shouldn’t be in charge of anything. I especially liked how the media was saying it doesn’t exist because they don’t have the girl’s information. The doctor can’t give the info out under HIPAA and the media has no right (ethically) to have her information so they can invade her privacy.

That’s why I wouldn’t trust my safety if I was a physician in these states. Too many untrustworthy/stupid/evil people in positions of authority tight now. Because that is the only options for the dental that this happened and the actions they have taken Someone in authority knew this happened. Despite HIPAA, this needed to be reported to dcf. They just didn’t care to investigate it before spouting offf

It was very brave of the doctor who did the abortion to speak up. Any other details she provided might have been enough for the media to find out the name of the 10-year old. Providing the name of the doctor in Ohio who treated the 10-year old and asked for help would have endangered THAT doctor- you know, "aiding and abetting". I hope that whatever the 10-year old sees of the media coverage, she understands that she has a tremendous amount of support and her tragic case has pointed out to at least some people how wrong these laws can be. And the guy who did it should be dropped off in Guatemala with just the clothes on his back. An American prison is too good for him.

I'm going to pretend they thought she didn't really exist since they love thinking everything is false if it displeases their snowflake selves. According to the article I posted the attack was brutal. Most 10 yr old girls are going to have a hard time defending themselves against an adult male. If they are pregnant and 15 or less, it should be deemed rape and finding the attacker should be less important than further traumatizing the child by forcing her to carry her attackers child and risk more physical and emotional damage.

Under 18 it is rape, especially when we're talking a 27 year old man. There's an argument for the couple that's been together as minors and now 1 is over 18 (and not older than 20), but adults preying on teenagers is rape.

Jim Jordan re-tweeted the Attorney general’s claim, then quickly deleted it. Hey Jim, this happened in your home state. Surely you have good contacts there that could have help you avoid looking like an asshole if you made a tiny bit of an effort. Or is owning the libs that important, and being an ass is the point. I would think that after what you went through(and denying it even happened), you would understand the need to get facts right.
