I don't see how the 9th U.S. Circuit Court of Appeals couldn't have seen Proposition 8 violated the U.S. Constitution.
It was the right decision.

Over the years I've changed my mind on this issue. (Call me Romneyesque. ) I used to be against gay marriage. But then I thought why shouldn't they be as miserable as the rest of us? (Just kidding honey......) It's supposed to be a free country right?

"Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," said Judge Stephen Reinhardt in the majority opinion. "The Constitution simply does not allow for 'laws of this sort'."

I don't mean to offend anyone here, but I think it is icky. That is why we need the Constitution to protect homosexual's rights, like everyone else. I think that's allowed. I have no issue with the "if you oppose gay marriage, don't have one" school.

I’m all for equal rights, certainly as they relate to gay marriage.
Divorce lawyers will be quietly celebrating. The Church of Latter Day Saints, which was the biggest supporter of Proposition 8, financially and otherwise, not so much.

Well as a very non gay person I must admit that gay marriage does not sit well with me. But if our constitution means anything about life liberty and the pursuit of happiness I also think it is wrong to deny anyone what is legal for others. I have had over the years friends who were gay and I have seen them die way to young from diseases related to that life style. I do not think it for the most point a healthy life style. But I also believe many are born with that pertinacity to be gay. Why I don't know. So on that basis I must be in favor of defending their right to live as all other citizens. It is a controversial issue that will never go away.

Dj the interracial issue has pretty much disappeared in the white community. But in the black community it is still a very sore spot. They will say what is wrong with you. Can you not find a black partner that is good enough for you. You not proud of your race. Yep that issue is still around in some communities.

I think this is an issue that the over 40's are still hung up on. I don't know anyone under 35 that gives a fuck about this issue. Most of them are pretty much of the opinion that all people should be able to marry whichever consenting adult they decide.
Why politicians & courts are wasting our time and money on this is...well, I'd say beyond me, but let's be serious, our government wastes our money on everything they touch.

Many people object to gay couples being married, because it goes against their religious teachings. Correct me if I'm wrong, but wasn't marriage always associated with religion? If so, why doesn't the government stay out of the marriage debate. If two people want to be joined legally, they can form a legal union. If two people want to be 'married' it will be up to the discretion of each individual church to decide if they want to preform the ceremony. That way any two people can be legally joined together and have all the legal rights the government gives to couples.

Some Christian churches and Jewish synagogues will perform a same-sex marriage in states where same-sex marriage are legal. So heterosexual and homosexual couples get their marriage blessed of the church.
Some heterosexual couples and homosexual couples don't care for a religious marriage ceremony and are content with being married by a justice of the peace.
Everyone mentioned above must secure a marriage license.
Why should one group be called maried while another group called civil unioned (or whatever). In the eyes of their respective states, they are all married (where legally allowed for same-sex couples).
They are all married.

I'd be okay with everyone getting civil unioned too, should government try to make a distinction between what happens at the courthouse and what happens at [insert choice of religious venues]. But I don't think a lot of straight people would go for that.

The report I heard yesterday said that the court ruled that once gay marriage was legalized in CA it was discriminatory to single out one group and take away what they had been given. The report made the point that if you replace 'gay' with any other group (black, Hispanic, Irish, Catholic), Prop 8 would clearly violate the US Constitution. The ruling did not touch on the legitimacy of same sex marriage, just that Prop 8 was unconstitutional for targeting one group.
That way any two people can be legally joined together and have all the legal rights the government gives to couples.
Two reasons why the government needs to be involved, first because individual state governments are not allowing same sex marriages, second because the marriages of same sex couples, married in states that allow same sex marriage, are not not being recognized in states that don't allow same sex marriage. So a couple married in Massachusetts can't move to Alabama and have their marriage and all the legal rights that go along with that marriage recognized by Alabama.
I will admit to also having a had a problem with same sex marriages when it was first legalized here. Now years later I must admit that I'm ok with same sex couples who have been married in our church. I've come to realize that these couples as well as those who want to change gender 'may' have problems but not from me.
