I said I'm kinda curious how much she actually paid towards Simpson. She took care of it directly.
I added to my complaint my concerns about why they want her actual physical identification and what their interest might be.
I put in she claims they aren't keeping her informed and are confusing her by handing papers to sign without telling her what they are.
Whoever is getting my emails is probably annoyed by now but I feel I is urgent I document in real time.
It's everything together that fully paints the picture.

So on top of everything it came out that DHs father is "very disappointed" in him for helping my dad and not being "man enough" to demand more answers from me. I'm sorry but this is between me and my husband. Those bonds belong to DH to do.as he wishes. And really THIS is what disappoints you about him?! I know that's mean but given my husband's past this is seriously where you draw the line? I'm going to try to be gracious. FIL is likely getting depressed and is struggling with being a widower and facing his own mortality. So he lashed out at DH and there is 30+ years of frustration behind it. But it doesn't make me less angry on Dhs behalf. What my husband and I discuss behind closed doors is none of his business. He can have his opinion the EAP lady reminded me everyone has their right to it. Doesn't mean I have to take it.But DH sure has taken it to heart. So much chaos. Thank you. I needed to hear that this morning. And totally FIL can piss off.

She could revoke the POA at any time. What you really need is a guardianship. You need the help of a doctor that will examine her and say whether she is having mental issues or not. And because you don't have one they can get her to sign anything. But I would INSIST one of you is there when they present things to her, of course, she doesn't understand, as you are looking out for her interest.
That nursing home knows better than that. I think they are just seeing dollars they can get. So have her sign up for medicaid, it will just be denied, or set to go into play once her dollars are exhausted. They may even ask why this is being done now.
Check with the state and see if complaints has been made against this home. With what they are doing, bet there has been.
In fact for the first 100 days of a stay, where she was transferred directly from a hospital, medicare will pay, so her private pay shouldn't be all that much. But someone also has to say it's medically necessary. Lots of pegs have to fit into holes for all this.

I know she can revoke and name and play games as much as her little heart desires.
My question is the whole claim by the nursing home is my dad abused her mental status by getting a POA on a poor old lady who doesn't understand to steal her money.
Which can easily be disproven by the lawyer. He would lose his license if he didn't do it properly which includes determine at the time she's legally competent.
So then how is it the nursing home can have her sign that paper revoking it? There was no lawyer involved just that woman.
Can't it just as easily be claimed THEY took advantage of a poor helpless woman because they also have a vested interest in her money?
That was another red flag I read about regarding nursing homes.
Or is everything so biased against family that it MUST be us. Nursing homes Can't possibly run scams.
The place is too new I can't find complaints.
However the real estate agent my dad was working with to prep the houses had her mom there.
She became concerned because they were insisting her mom was combative and violent yet any time she was outside the place her mom was fine.
She struggled to get them to let her mom leave too. She's given my parents the name of where her mom is now and offered to help see if since her mom is there she could recommend a patient or put in a good word.

FWIW, If the attorney agrees to talk to you Tuesday, try to have your list of questions written down ahead of time and keep it concise without too many detours about "what if this, what if that", etc.
Only mentioning this because hourly rates add up VERY quickly, especially when most attorneys have timers on their phones.

I may be paranoid but I wouldn't put it past them to try but they'd have to involve an attorney who isn't going to declare her competent if Saturday was anything to go by. It'd have to be a completely separate court ordered person or another family member. My brother isn't going to can't blame him.and GU is incapable.

I've had some issues with the nursing home, but nothing like this. I just can't get my head around it, I must be missing something here.
And with my mom, no issues at all.
Do not sign anything saying you will be responsible for her bills. My poor old mom could hardly write but she did as I would not and she did not want me to. Back then we could have not paid for it.

I think Grandma is private pay, not under Medicaid. Medicaid will not pay if you leave the hospital AMA, but that's a hospital. I can't imagine a private pay patient not leaving a home if they want. I had to check myself out of the hospital AMA when I was in KY. The nurse tried to tell me that my insurance would not pay for the 9 days I spent there. For some reason, she thought I was a Medicaid patient (not sure why, I had the same medical insurance she did). But when you are covered by medicare from a hospital to an approved facility, medicare will pay the first 100 days. That's all though, as they do not pay for custodial care. But if the doc says she is ready to be discharged they will stop, I think they review every so often. It's been awhile.
If they are under medicare guidelines, they have to do everything by the book.
If she does not have a supplement then she is responsible for the 20%. Part B pays for the doctors.
You can talk to the billing department there and see how she was admitted.

The people that have medicaid can only get it with less then $2k in assets. She is allowed to own a home. I looked it up yesterday for us, up to $583k, more in California. And a car.
Someone that has medicaid then is 100% covered. She will have Part A, Medicaid, and Part B premiums will not be deducted from her SS check any longer. Under Medicare and Mediciad they will only be allowed something like $50 a month out of their SS check for personal needs, and the rest goes to the nursing home.
They are not required to get B and a supplement but are strongly advised too. If they don't every year they do not pick them up a 10% surcharge is added to the premiums.
It is all so confusing.

It was very kind and generous of your DH to lend you the money for the lawyer .. but his current attitude is not good news. Which is frankly infuriating, because HOW MANY TIMES HAVE YOU COVERED FOR HIM/BAILED HIM OUT OVER ALL THESE YEARS! Please know that we are all rooting for you!

Because she fell last Thanksgiving and it was bad enough it was ruled she can't live in the one horse town known as Treynor Iowa because there aren't any services. We have no where to house her. Before my parents had any time to look the hospital discharged her to this place. She was moved from skilled nursing to their living area. My parents have been looking but they all talk. The current home has been making all these claims about her medically so they haven't found a new place willing to take her. And they all refused to talk to my dad without a POA. Which is why he got it done. That and the nursing home was pushing father to take over her money and medical care and told my dad he couldn't do anything about it without a POA. Three hours after he submitted it to the home it this all started. My grandma has more money than any of us realized. Unless she starts buying sports cars for everyone it'll be 5-7 years before she can even qualify for Medicaid. Since she is paying 100% out of her pocket the nursing home is supposed to MYOB. She has the right to move anytime she wishes and spend her moneyas she wishes

Hopefully it all falls apart either before or after it gets to court.
Yes it is a real detective that was my mom's first thought too. His identity was verified.
I told dad we'll have to let the lawyer do his work. He's gotten people off on stuff worse than this.
Hoping he'll find dirt but I'll take what I can get. He's guarding my grandmother's personal information and is the one who said let them back themselves into a corner because the longer they make claims the longer the bill doesn't get paid.
Since they claim she medically has to be there according to what I read we'd get 60-90 day notice before they can kick her out OR they have to cooperate in finding her another facility.
2-3 months is not chump change. Without her informatio they can't finish the con
Lawyer said it's a big nono demanding her identification and the DHS does not have authority to take it. Before he even agreed to take dad on he told dad to give it to the lawyer the wallet and tell the nursing home call.him if they want it so bad.

Well now I know why they were waiting. My coworker whose family is going through the same thing, in their case it's other family members coming out of the woodwork, are going to court in a week. As of July 1st what they are accusing my dad off is now a felony. I really hope the lawyer works his magic. He's gotten people off on much more serious stuff. ETA: He's going up there sometime this week to talk to the nursing home and see my grandmother. He can draw up another POA. I have agreed to be grandma's POA at this time. I don't want to but I don't see any way out of the jam we're in unless I agree. but if the alleged "crime" (it's not a fucking crime) happened prior to 7/1, it's still not a felony. The actions had to happen after 7/1.

Great news! I think they had hoped that you were not going to fight back. It seems like they thought that threatening your dad with jail time would make the family back down and cower to them. Glad you stood your ground! There is an old saying about pickup lines, something like "you might get smacked nine times out of 10, but there is still that one time that pays off".

The money is going now to doing things the right way, not that they were wrong the last time but more air tight. I'll still be named her primary POA. And they are going to work to get things set up in regards to selling the house and the rest of her money the nursing home does not have access to.
