It also states in the link that it "appears" the man "may" have been placed into a choke hold.
There was really no way to see what exactly was going on in the amateur video.
It stated they were attempting to restrain him in order to be able to get the cuffs on him. Given his size (height 6'3" and weight approx 350lb), it would have taken more than one officer to do that. And very likely more than two, - especially if he was resisting or putting up a struggle.

Exactly. In most government jobs some sort of "detached from normal" duty is assigned while a person is investigated anytime there's an investigation. "Desk duty / stripped of badge" doesn't mean anything other than they are investigating it. If he's cleared, he gets put back on patrol and gets his badge back with no mark on his record.

So, getting the death penalty for selling black market cigarettes seems reasonable? Shooby-it was not the intent of the officer(s) involved to execute the man. The intent was to subdue him.

As for this particular thread, I did not even bother to look at your opening post link its soure because, surprise, surprise, the event and video was already all over the news. I didn't see him fighting. No, but he was arguing and resisting. When the police tell you to put your hands behind your back, etc, it is best to comply. If you feel it is a wrongful arrest, there will be plenty of time to press charges or sue afterwards. the police don't tend to change their minds once they've committed to putting someone in handcuffs...why people insist on resisting is beyond me?

Actually there is a common takedown move that employees pulling someone down by placing your hip behind the adversary and wrapping your arm around the person's collarbone (neck). It can look very similar to a chokehold, but should end up with the person rolling over the hip and onto the ground. However, with the size of this suspect compared to the arresting officer, and any sudden movements made after the takedown was applied, it may have inadvertently turned into a chokehold. My guess is that will be the argument in defense of the arresting officer. sicne the man was resisting arrest prior to the supposed "chokehold" then that argument may very well hold up.
