OP, as others have said PLEASE make sure the divorce decree states that you can move anywhere without requesting "permission" prior. My oldest DD's bio. father, put a restraining order on us when we tried to move with my new husband who was in the AF (and this was way back in "94). It took 2-3 weeks, several hundred dollars in lawyer fees and an emergency court date to get it lifted and the child custody rewritten so that I had sole say in where her permanent residence was maintained, I only had to notify him and the courts with the new address. Then a yr or 2 later we wound up revoking his parental rights anyways so that my DH could adopt her and he didn't put up any fight as he had only spoken to her maybe once since we moved and even his mother said it was for the best. But anyways, what i'm getting at is just because you are in the military won't mean anything if he tries to fight you PCSing with the kids, get it spelled out in black and white.

thank you, I will definitely bring that to light. I don't understand how the state level can trump the federal level -- that makes no sense to me.

Twinmama, think of it this way. Child custody is a state issue. If the military moves you, the orders apply to you, not your kids. If there is a restriction in your custody agreement that the kids can't be moved out of state, the restriction is their move, not yours. That is why you need to have it in your custody order that you can move the kids consistent with the military's transfer orders. Not sure what would happen if you were deployed overseas, but that is something to find out. Twin California is a no fault state. They are going to put your info in that lil calculator thing the judge or somebody has and figure out how much child support to charge. My ex pays nothing (no child support, alimony, he won't even help me pay for our daughter's hair to get fixed) because he actually sued for and got joint custody. That being said I would still do what the major of the posters are saying file for court ordered support.
