I am sure you are going to love this! Shopping at the supermarket with DH. Took shopping cart outside and unloading when car next to ours deciding to 'get out' and hitting me pardon in kabooze. I am falling on my face an she keeps driving while my husband banging on her car trying to make her stop. Little lady (74) very vibrant getting out and looking at me and started to yell 'I didn't see you'... I am like 'what? you had to look!!!' And she said 'get into my car and see if I could see you!!!' And I am like 'what???' My DH is 6'2" and I am 5'8"...so it was knd of impossible 'no to see us' if he was looking.
So to make long story short I am hurten and bruised and probably will have to pay people to work while I am getting therapy on my back and leg. I said to my husband that I was so scared she will run over my leg and he said...'THAT would be a good case!!!' I think I still have one! Don't I?
P.S. Went to law office and Hospital to check for fractures. Got police report. I think I am set.

I don't know what the standard is in PA, but in NY you have to have a substantial physical injury for there to be a lawsuit over a car accident. Bruises don't cut it.
But her insurance should pay for the therapy and the wages.

Chronic lingering back/neck pain which is impeding your ability to work and function. There's basically no medical test anywhere that can definitely say that you do or don't have pain. You don't have to know why you're in pain, your doctor doesn't even have to be able to give a reason although if you keep coming in claiming horrible back pain they'll eventually come up with one.

Geez, loony, you're lucky you weren't hurt even more seriously. Did you call the police? I didn't because I was in shock! But because she was yealling I got angry and asked her for the papers. She gave me DL and I got her info. We drove away and I felt when DH was hitting something I was in pain. So by the store we have law office and we went to see if anyone will tell us what to do. Lawyer said to get the police report and go to the Hospital which we did. I went to chiropractor yesterday and paid cash. Today I am seeing someone in rehabilitation center. Lawyers are of on vacation. Will see them later.

I'm pretty sure your medical records will be brought up during the trial so keep the story consistent. Pick a fairly specific location on your back/neck where the pain is concentrated. Keep the symptoms consistent across your visits. Throw in migraines. Back and neck problems can cause migraines, another thing they can't really test for, and those can be bad enough to be debilitating.
So what? Most legitimate sufferers of chronic pain are told it's all in their head, or branded a drug seeker, by at least one or two doctors before they find somebody that actually tries to help them.
Start with your regular doctor. You have a history with them. Preferably a long one with no previous signs of trying to score prescriptions that you didn't need. Why wouldn't they believe you?

The thing is...I do have problem with my back in 5 places and I was told by my doctor I should live with it until its bad, really bad. My massage therapist told me yesterday I did get some new 'issue' after the hit. So I am not even pretending. Its there! I don't want to be crippled because of this moron who 'can't see' but can yell!

Oh, and don't sue right away!!! That's going to look fishy as hell. For now just go to your therapy appointments, or whatever, contact your insurance company and follow their directions in terms of contacting the other party. They'll probably tell you not too, and handle getting money from her insurance company themselves. Right now you're just an average joe that wasn't injured that badly and want to get better and forget this whole thing. A few weeks from now you make an appointment with your doctor to discuss the pain that's still not going away. A month later you make another one and demand tests to figure out what's still wrong because it's clearly not healing right. You basically get more and more pathetic each time you talk to him. The pain is there, it's getting worse, you're starting to get headaches. It's affecting work.
You sue the lady that hit you in 8-12 months when the pain, doctor's appointments, and prescription pain killers are negatively impacting your life.

Why are you saying 'in their heads'? If docs can't find a reason for the pain, they often say the person is makiing it up, usually to access pain meds, or to get out of working, or both.

All pain is in your head. Your nerve endings just send electrical signals to your brain. The nerve itself can't tell the difference between tickling and burning. The brain interprets the signals coming in and decides that some mean somebody with really soft lips is nuzzling your earlobe and others mean something the approximate temperature of the surface of the sun just touched our arm.

But it's Loony we're talking about here. I have MRI from 3 years ago where it is shown that I have 5 problem places. I have been seeing chiropractor on and off for the back pain for a few years. So it is all documented. swamp, so...can I get rich?
