I am actually listening to the Dark because as I had mentioned I have a big back issue. I don't know how this hit had affected me because they told me in the HOspital it can be that I am still in shock and not feeling anything yet. I am really afraid it is going to hurt later. It is going to hurt later. Why will it hurt me and can I sue too?

After all these years it turns out DOOW was right... Seriously Loony I hope you are Ok. Whats the DOWW? Doow was a poster on the old boards who's only reason for existing was to complain about Toyota. Actually he was complaining for a while before the Toyota problems became commonly known.

So to make long story short I am hurten and bruised and probably will have to pay people to work while I am getting therapy on my back and leg. I said to my husband that I was so scared she will run over my leg and he said...'THAT would be a good case!!!' I think I still have one! Don't I? P.S. Went to law office and Hospital to check for fractures. Got police report. I think I am set. If you have a witness or two that might help your case more.

First, I'm glad you weren't seriously injured or killed.
Second, I'm thinking it will not bode well for your civil case that you went to a LAW OFFICE before you went to a medical professional or law enforcement. I'm afraid that reveals your true intent far more than you should want it to.

The fact that you have existing back problems will actually make it very difficult to win a substantive claim on new injury as a result of the auto accident. They will leverage the fact that you already had problems & that is the cause of the pain and injury.
It does not matter when you went to the attorney, that is privileged information and does not need to be disclosed. You do need to keep a careful record of all of your treatment and results + receipts so you have a cohesive record.

Instead I just wanted to get away from that place and drove off. While 'geting away' I felt pain in my back. And because I don't have health insurance anymore I've started to worry. Bypassinglaw office I told my husband to stop by it to ask what to do.

First off - go to a real doctor. Not a massage therapist, not a chiropractor, etc. If you do have chronic pain and want to pursue this later, a jury will respect you more if you used traditional medical practices to find a solution.
Second off - we need stricter laws about keeping your driver's license as you age. They have about 25 years to get them into place - because I will be that crazy out battleaxe that will refuse to give up my car - so quick, young people, lobby for it like your life depends on it. Because it might.

Unless you're getting a massage by a student at a massage school, the cost of a real massage isn't much less than the cost most docs will charge a patient who is paying cash. And, like Thyme said, her insurance will be paying for it.

I would call the woman's insurance carrier and ask them if she's opened a claim yet. If not, you should report it and give them your information right away. Ask them for the claim number and then go see a doctor and tell them it's covered under No Fault and give them her insurance information and the claim number.

When I was in a car accident (4 years ago), the doctors required cash payment up front when they heard it was an accident. They would not bill it through my health insurance and said that I would need to recover my costs from the other drivers a auto insurance. I had an EF to pay cash, but it took me almost two years to settle and get reimbursed by the other guys insurance company. And that was an accident where the police came to the scene and the other guy admitted total fault. Without major medical claims this might be good for a few thousand for soft tissue injury.

Second, any competent defense attorney is going to want all medical information on your back since you stated you already had problems - they are going to claim its only an aggravation and that the original injury is responsible for most of your pain. As to loss of consortium - yes, it gets VERY personal and in most cases through embarassing deposition questions the claim gets dropped because people don't want their sex lives on display.
