No, no,no, my issue is with deliberately delaying the process. I am all for the burden of proof, you cannot just sentence someone to death based on manufactured evidence or false testimony. But once it has been proven beyond reasonable doubt I don't see why it takes so long? A normal appeal takes what 45 days? Once all appeals have been processed why does it take 20-30-40 years to execution? That is my issue! I know many sentences have been overturned when new evidence surfaced but that is generaly in cases that were processed before DNA analysis. And i see some people wonder why is Manson still alive? Maybe because he never physically killed anybody?! He just caused discord and planted ideas. Just because a different person is the "weapon" doesn't mean Manson didn't "pull the trigger" that caused the different person (weapon) to kill. However, Manson is still alive because his Death Sentence was commuted to Life in Prison Without Possibility of Parole... as were ALL Death Sentences in the state when California abolished the Death Sentence.

Thanks for enlightening me! I mean it! when it comes to subjects as these I am more of a novice kinda the he only time I had to deal with the legal system was after entering the country(US) and was on immigration matters. That is where 45 days for appeal aplies. Sometimes is even less. Didn't need to do it but I was made aware of. So by paralleling I assumed that it takes an average of 45 days for an appeal. the rest of what I said is just about how I feel about the issue: give all the same fair shake and once something is proven get on with it. But again to beat a dead horse here, how and why is one even given the time of the day for an appeal if it was proven "beyond reasonable doubt" and with irrefutable proof of guilt? Yes, it is the law and is his/her legal right to apeal any decision but why isn't that expedited and all BS that defense attorneys throw at the case just called for what it is and become efficient. Wasting funds on an already lost cause takes away funds and time to spend on a case that is debatable or there is no verifiable proof. As Richard already said, cases prosecuted and convicted 20-30 years ago are still questionable about the fairness or accuracy of accusations. And I see merit in fighting those. We just wanna make sure that if we put someone to death we don't do it to the wrong person but for those where the guilt is clear I don't see why should take so long. and since we are on the subject and I guess you are a lawyer hope you don't mind me asking what is the average time for an apeal in a case of capital punishment? Just for my own curiosity! Thanks!

... what is the average time for an apeal in a case of capital punishment? Just for my own curiosity! Thanks! The following link shows how long those executed in 2014 were on Death Row. You will have to do the math for an average. Execution List 2014
