Swamp, as single states, You can negotiate with the insurance company. I would get replacement cost and counteroffer with them. The damages aren't even close to what's needed to total it. The won't give me replacement cost. How much would be needed to total the van?

Swamp, what about pain and suffering ? You were injured. Won't the driver's insurance give you any compensation for that ? My injuries don't meet the definition of the injuries needed to recover for pain and suffering. I had some bruises and was sore for a few days. You need broken bones.

I think that they should pay you for the time that you've lost at work ( as in your average earnings per week, whether you are self-employed or not ), and something for your injuries. You go the scare of your life, I'm sure. It might not hurt to call the insurance adjuster.

You might need to miss a few days at work, to look for a new car. Not an unreasonable thing to do. Esp. given the time of year it is. You need to see them in the daylight, and it's safer to test drive them during the day too. Right? It's them, that put you out, not the other way around. Keep that in mind. I think I bought a car. Over the phone. 2014. No 2013's left. About $34000. Insurance adjuster also went up about $600. Selling my van for salvage tomorrow.

Not in NJ. Bruises do not qualify, unless you buy the zero lawsuit threshold, which costs a lot. And you have to sue the other person and win damages.

And you have to sue the other person and win damages. then it's changed since I lived there, was involved in an accident and asked for damages. was ready to go to court but they settled outside of court (and since they were the ones cited by the police I'm not really sure how they thought they had a claim)

I bought a new van via phone from the place I bought the one that was wrecked. I pick it up tomorrow. They were very accommodating. I had to pay an extra $1100 to pay off my lien and I will get the $200 deductible back in a few weeks.
I got about $17,000 from the insurance company for damages and $6500 from a salvage guy. He picked it up Wednesday.
