Not to below 8 ounces. Unless the plants in question are really young. Besides, that makes you look guilty. She'd be far better off getting the prescription, which according to state law allows you to grow up to 3 or 4 plants for personal use. If the cops show up to confiscate her stuff, take it court and argue that you weren't doing anything wrong according to state law, and hope the prosecutor either decides you aren't worth pursuing, or you can convince at least one juror to hang the jury by refusing to convict.

Unless the feds are just being complete asshats, I can't imagine they would go after someone for 3 or 4 plants. around here, you need over 100 pounds for the feds to even consider takign the case.

TV cameras are a bit of a game changer, though. You really don't want to be the elected official who ignores this small farming community on TV. It lowers the asshat threshold.

They may not need a warrant if it is visible from off the property. However, the tv channel has no right trespassing, although no one really prosecutes simple trespassing. However if the property has No Trespassing signs, it goes to a minor felony. There is no such thing as felony trespass. If you property is posted and someone goes on it, it's a violation trespass, like a traffic ticket. If someone goes in your house, it's a criminal trespass, a misdemeanor. Sorry Swamp, that is what my lawyer neighbor told me when he posted his signs, when we had a snoopy neighbor that would just walk around his property anytime. I put some up too.

I have the required amount of "No Trespassing" signs on my property to keep people out. We have an issue here where in order to be able to use deadly force to protect your home/life you are supposed to post the signs telling people they are not welcomed.
Most people here are building long fences out at the road, closing off their driveways with gates, and putting large dogs behind them. I will have a fence by next spring and will never be without certification again. Just stupidity and cheapness on my part...
I drove down this morning and bought a prescription and my plants are now legal. I was told that since they didn't talk to me about them, I am fine if they come back with a warrant because I can now legally possess them. Because my plants are not yet able to be harvested, they are still considered "immature" and the script covers me for when they are harvest-able and a bigger legal problem.
My DH had an RX but I never bothered to go get one because they are expensive, a total racket, and I didn't see much need for my three small plants growing well out of sight. I am not exaggerating to say that I literally know of one neighbor in his 90s that does not grow. I have no one else in my neighborhood without at least 6-8 plants and many with lots, lots more.
I also fully support law enforcement checking their status and legality. I have a problem with them hassling me over 3, but it didn't appear they were interested in me, just the farm next door. Hopefully it will stay that way, but I posted my script where it is supposed to be and anyone in my yard now knows for sure that my plants are legal.
I assume when we talked yesterday they had already been all over my property (we have prints everywhere in the sand) and that we were playing a game of "don't ask, don't tell" about my small amount that is clearly for personal use. However, once they showed up last night with the spotlights and were clearly looking/counting my plants, I decided it was kinda dumb to pull them, because they clearly know they are there. It is also clear though that I am not selling, have no record, don't rent and all the crap they tend to care about. So, I assume they won't be back for me at all. But, I do feel better.
I did not appreciate them all coming out of the woods when we pulled up to ask if the film crew was lost... I know they can't just come here with no warrant and trudge around looking for someone to bust. They said they had a complaint, but I am the least of their problems. Just down the road about 1/2 block I have someone with a literal forest of 10' plants which are not fenced and only about 10 feet from the public road. They, IMHO, are asking for a "compliance check."

So, here's my beef with medical marijuana. Yes, of course. If someone has a medical prescription for pot, and is toking up to relieve their "anxiety" or whatever, and then they go out and drive while high, and hit me, and injure or kill me, then are they liable for hurting me or killing me or mine ? Because I can tell you this. I don't give a flying fucking rat's ass about whether someone has a prescription or not for their pot. If they hurt or kill someone when they're driving, to me they're just as liable for their crime as anyone who is driving drunk. High is high is high.
Half of the people who have a prescription for m.m. around here are just old potheads who now have prescriptions, and who smoke and drive....and come to work high. I work with one. She gets on my fucking nerves because she's high all of time, drives to work while she's high, codes while she's high, and drives home while she's coming down. And I get really tired of smelling her stinky pot breath and listening to her inane high giggles all day. Her eyes are as bright as a squirrel's when she's high, but those don't bother me. Why do I have to work with a fucking high pothead just because she has a m.m. prescription ? If I came in to work high or drunk, I'd probably lose my job. I don't think it's all benign whatsoever.

Yes. Just because you have a script doesn't mean you can drive impaired. The same goes for oxy's and other controlled substances.

Thanks for the answer, Swamp. We seem to have so many m.m. users around here now that I was wondering. People get very defensive about being able to work while high on their medically prescribed marijuana ( buying the prescription is rather a racket around here too, ala Shasta's post ), and they drive while high for sure, because they have to get to work. You can't toke up in the parking lot at the hospital.....
I do believe that m.m helps people with terrible contractures due to their nervous systems being affected ( M.S. patients, for example ), and helps with pain due to cancers and other chronic conditions, but a lot of the time, it's just a front for plain illegal drug use and pot growers. A lot of our county prosecuters' offices have been looking into this and making cases and convictions on the fronting for illegal drug production and use. And m.m. is legal in our state. They just feel it's being abused, and it may be voted out at some point.

The same reason we all have to work with people doped up on prescription pain killers. We either let them take their meds and be able to work, or they sit at home on welfare and we pay for them to get high there. If they're going to get high either way to deal with their condition, I'd rather they work instead of sit around watching cable while I pay their bills.

If you drive and hurt or kill someone around here while on prescription painkillers, you can be prosecuted for manslaughter and put away for a few years. It's happened, especially if they find a (legal) amount of alcohol in your system.

The same thing will happen if you get in an accident because of your medical marijuana. It's treated like any other prescription drug, most of which have labels warning you not to operate machinery and whatnot.

I don't ever drink and drive. I also never smoke weed and drive. I consider them both to be illegal and a very bad idea.
I also would never smoke weed in/near/around/at work. When you are working you should be sober.
However, just as some people enjoy a beer or some wine in the evening to relax, I appreciate the fact that I should be able to grow and smoke my own relaxation. My weed hurts no one. I could make my own beer or wine. Why can't I grow pot?
I think this is a stupid thing to spend tax dollars on. If people could grow their own supply you would find the cartels leaving the forests - not ruining it.

People here are (for the most part) fine with faking the system/breaking the law (buying a fake prescription) to get around drug charges, but I ask a simple question about how to deal with an issue in my daughter's school and I get attacked, called all sorts of names, and virtually ripped to shreds.

Well, when I go to a doctor, and get a prescription for something - I don't say I 'bought a prescription." I drove down this morning and bought a prescription and my plants are now legal. I see the doctor, they tell me what I need to take, they give me the prescription to take to the pharmacy and I fill it. The only 'buying' going on is me purchasing the medicine from the pharmacist. In GPG's case, she would not need to 'buy' anything - her 'medicine' is in her back yard.

But when I went to my doctor for migraines eight years ago, she sent me for tests to see why I had the migraines, not just write me a prescription for medicine (that I told her I wanted) to mask the effects of the migraine. My doctor sent me to a neurologist for tests - found that the cause of my migraines was sleep apnea I get a CPAP machine and I have never felt better - no migraines in 8 years.
Any doctor who just writes a scrip for a narcotic based on what the patient is requesting has to know full well that the patient is trying to get around the marijuana laws. And as such, is breaking the law themselves.

By the way, what did you decide? Are you letting sleeping dogs lie, talking to the school administration, looking for another school for your kid? I have to be honest, I don't really see the issue with your daughter having a teacher that's a single parent, but I do realize it's an issue for you, so I'm curious how you're handling it.
