I tried to post earlier today but the message didn't take. Thanks Chiver for your input on my table. I noticed that there were still several things in the table that wasn't part of my debt. Guess I didn't get it deleted from the sample table after all. Everything under the mortgage entry except the EF is not part of my debt. I just have the 4 student loans for my kids and my mortgage. Guess I'll have to find a fix and try it again.

*sigh* OK. Chapter 7 is for unsecured debt. Chapter 13 is when you're having problems with your mortgage as well as your unsecured debt. Not having problems with my mortgage. BUT - here's the fun part - I am taking 10 deductions from my pay, because I am a firm believer in not giving the IRS my money and then waiting around for them to give me a refund (which, especially with the gov't shutdown would make me really unhappy right now, anyway), but my taking those ten deductions gives me more available funds which means no matter how I get around it, I've got more "disposable income". (ha! have we met? "disposable"? Yeah!!! ) So I have to change my deductions. It won't take long - one pay period - but it will mean I've got to spend a couple of months with an even tighter belt until I get to bankruptcy court. The "disposable" income is what this is all about: a declaration of bankruptcy means you can't keep up with whatever payments, and then the court decides - based on your "disposable" income - what they expect you to pay off in five years. There is no more interest. None. Nada. Zip. Zilch. And everyone in the declaration is paid off during the five year stretch and then they're gone-zo. Exceptions to the time limit are made for mortgages , car, and student loans, they are extended for the life of those loans, but the payments may be interest free or deferred during the bankruptcy term. If I declare for Chapter 7, I can pick and choose my creditor problems, I can limit which cards I want included, etc. (I could potentially limit it just to the one card threatening the lien). If I declare Chapter 13, they'll include everyone, I can't point to just my cards, I have to include the student loans and my mortgage, even though I'm not having problems paying them. But here's the conundrum - I have huge disposable income, even if I go down to zero deductions. The lawyer looked it up - he thinks I'm going to have to declare Chapter 13. The good news is, I don't need to buy a house or a car right now, so far as I know I won't need to buy a car in the next couple of years. And I have the potential to actually save some money so if the time comes I need to buy a car, I can do it with cash. The bad news is, of course, declaring Chapter 13 would mean I'm stuck. Period. Chapter 7 can be paid off sooner, if possible. And it looks rosier in two years to creditors, I couldn't get NEW credit, but I could still do things, like use my Macy's card, or my Target card. Chapter 13 is a serious black mark, and I won't be able to use my cards, get my discounts, nada nada nada. So first things, first, I have to get HR to reduce my deductions. The 10-day demand letter I got this past weekend (did I mention that? The collection attorney sent me what's called a 10-day demand - respond or get an automatic judgment) has a court date of October 12, so I need three months at the reduced deductions to go into THAT court hearing, plus I need to get my deductions changed before I go into bankruptcy court within the next month. Then we start figuring out if I can squeak out Chapter 7 - which is far preferable to me - or if I'm going to have to do Chapter 13. I'm waiting for this to hit me between the eyes. I'm amazingly calm, I don't know, I think - the last couple of years, with problems and headaches and whatever, it's just one more thing, it doesn't seem to have sunk in or something, I dunno... *************** Disposable income means anything over and above necessities. My mortgage is a necessity. My car payment, car insurance, gas, maintenance, tolls, are necessities. Utilities, groceries and medical expenses are necessities. And they allow 1/3 of your mortgage as necessary maintenance for your house - if your mortgage payment is 600, you need 200/mo to do repairs, maintenance, improvements. And they allow for toiletries, dry cleaning, clothing, but that's a fixed number per person, per location, so based on PA, me, by myself, I have an allowance of $121/mo. They also allow for pets, $18 for a cat, $27 for a dog. After these things are erased out of my take-home pay (change the deductions, change the deductions!), everything else is "disposable". Everything I pay Discover, Chase, Goodyear is "disposable" cash... And I gotta do this. I don't really have any other option at this point - if they garnish my wages, they can take 100% of my "disposable" income, which would mean - I would haven't anything left to pay anyone else anything. And the liens start rolling in..................

From my understanding many companies will settle for a percentage of the total debt. Do you have the option of taking out a bank loan or home equity loan and paying the debt off then repaying the bank loan? Just a thought. Hate to see you go through this since you have busted your butt to get to this place in your race

Hate to see you go through this since you have busted your butt to get to this place in your race Original debt with BofA was $29K. With the penalties and exhorbitant interest, now $33K. Mortgage - $151K. Current value of house - $123K. No such thing as equity. Bank of America was unpleasant in the extreme with me three years ago when this began. When I called them - BEFORE I had problems - and asked, "why are you raising my interest rate," they blew me off, "you owe us money." Uh, yeah, but, WHY are you raising my interest rate? Cuz they could. I went from 11% to 22% over about 8 months. Not because I was late. Not because I was short. Not because I was doing anything except paying my bill in full on time every month. Because they could. Lending laws have been changed so CC banks can't do that kind of thing anymore, but they all got away with it for awhile, and when they were losing money because people were losing jobs and had nothing to pay their bills with, that's what they did: punished the people who were paying their bills, made THEM responsible for everyone else. When I *did* ask them to work with me after my job went kaput, they said, "Use your savings. Close your CDs. Sell your jewelry. Sell your stocks. Cash in your IRA and your 401K. Buy a cheaper car. Take public transportation." Yes, they really said all these things to me. They'd doubled my interest rate, and doubled my minimum payment, and told me to put myself into complete hock to pay them, they didn't care that I was unemployed, broke, limping along, and as far as they were concerned all the other creditors I have who had no problem working with me on reduced interest and reduced payments (Discover even called ME and offered it to me before I called THEM!) were a bunch of wimps. This new bank that bought my debt wants the whole thing in a lump. And the attorney is suing - no discussion, no compromise. This is three years.

Just real quick, lark. First, my heart goes out to you. I really hope this all works out for the best. As one who works for a collections (among other things) attorney, I never understand how people who are doing everything right are the ones who get punished (luckily, we have consciences here, and don't sue just to sue). About the demand letter from the collections attorney - it's simply that; a demand. They can't take automatic judgment. We've sent out several demand letters before filing a Warrant in Debt, at which time, your attorney could claim he has a conflict and request a continuance, and keep this going for a while. (I'm assuming it's the same with you as it is in Virginia, with the initial demands anyway.) However, as ones who definitely prefer to get SOMEthing, we always encourage settlement or a payment plan of some sort. And the collections attorney would be stupid not to recommend his client accept it. Especially in this economy. I hope it doesn't come down to you having to file bankruptcy. You've come so far, and done such an amazing job. I'm thinking good thoughts for you.

Well... Saturday evening - after going to the grocery store and spending $83 nervously on "cheap" staple food... I came home to a letter with a petition to the court for a default judgement. Nothing looks like it's from the court, yet, it all seems to be coming from this attorney's office, but it sure looks nasty. I dropped it off with the bankruptcy guy this morning on my way in to work, he said he'd call me when he checked it out, and I haven't heard from him, yet, so I'm hoping it's just preliminary or something. I am amused, however. The original notice was dropped off unceremoniously at my house when I was out of town, my neighbor was over taking care of my cats. She's this itty-bitty Puerto Rican woman, maybe 4 ft 11 1/2 if she stretches reeeeeeaally tall, about 105 pounds (all boob), 33. I'm 47, 5 ft 8, 230. The courier who delivered the thing didn't ask for id, didn't even ask, "Are you...?" just dropped it off, when she asked what? who was he? what was this? he just said, "It's self-explanatory," and left. So he described his "verification of recipient" - a woman of 50, 5 ft 6, 140 pounds. I showed my neighbor. She laughed - either he's blind or he had a rough description of me, apparently, and couldn't decide what to lie about first!

I have my first 0!!! I got back some tax money and paid off the Raymour card and a couple other non-racing debts and stuck the rest in bank. I actually have an emergency Fund!! I just have to remember that it is for EMERGENCY only!!!

For the past two weeks I have been paying an extra $20 per week on my mortgage principal. Doesn't sound like much, but that would be $1,040 in a year, which is the equivalent of one full payment and a little more than half of another, so over the life of my mortgage loan -- 30 years, 360 payments -- that's equal to 45 extra payments, or almost 4 years shaved off my loan. I will keep up this pace of $20 extra per week, so far it has fit fine into my budget, and I might increase it to $25/week at some point. I hate debt, and I want to pay these off so badly! But I will keep in my savings mode, sock away as much as I can in case something happens with my job, and just add a little bit to the principal of the debt.

Hello all! I know, it's been awhile. I'm kind of bummed because the discipline that I used to get me down to one credit card went out the window when I actually got down to that last card. I will be posting again next week with my current progress...once the May mortgage payment clears...well, actually, when I get back from my trip to Knoxville. I will also be including the credit card that I use for my Mary Kay business. It used to be two cards but I was able to pay off the second one with my tax return. See you on the flipside.
