My Footage on Discovery Chanel - Is This LEGAL?

I posted last summer on the day I came home and found the Discovery film crew in my yard, and the drug task force guys coming out of all the bushes.

I told them I did NOT want to be on camera, and I did not want my vehicle on camera either due to security concerns of being a single woman in a rural area surrounded by farmers.  I did not sign the waiver to be on camera.

Watching the new episode and they show my truck and say I informed them on another property we did NOT even talk about!!!  It looks like I am ratting them out and it isn't even my VOICE!  They overdubbed "me" talking to them!  WTF?

Do I have any legal recall?

Excellent.  They should be able to guide you through this.  It sounds like a real screw-up on the part of Discovery.   Why they'd do such a thing is a mystery to me, but stuff like this happens.  I'm just sorry you've been the victim.

Its not a mystery. They make mistakes & probably took the wrong person out of the clips.  These aren't rocket scientists making films and supposedly keeping track of things.  You would be shocked to see how many errors there are in newscasts if you were a participant in the events.  I'm not sure if the majority of the population is stupid or just doesn't care whether they do a good job, but I could not make that many errors in my job and stay in it. 

You have some recourse, but it isn't clear what your damages are.  If you are harassed or vandalized because they have ID'd you as an informant, you definitely have damages.  Maybe even to force them to fund your relocation

I think I know the series you are talking about but will not provide a link.

If they showed your face and "dubbed" your voice, perhaps showed your truck license plate, showed readily identifiable pictures of your residence and, lastly, did not have a signed waiver for any of those actions, I "think" you have reason to be concerned regarding "possible" retaliation by growers as well as.

Because of that concern, it wouldn't surprise me if you had legal grounds to take action based on a "reasonable person" test - in other words, would a "reasonable person" feel the same way.

Given you have only recently learned they are showing this episode, in addition to the attorney contact, I'd recommend that you also notify the local authorities of your concerns sooner than later - the more people that know about this the better.

If you have neighbors you are comfortable with, I'd let them know as well - they could be of value in the event they see anything "suspicious" near your home.

I do not know where the bus property is.  I will go drive around and see if I can find that neighbor.  I did also put in a call to the Sheriff's Department to see if they can tell me where that is located - so I can go talk to them and let them see that is NOT my voice!

That forest grow they pulled 2K plants from that location and it was occupied by 4 ARMED Mexicans who ran when they raided them.  I did not inform on that grow or even know it was there.  It says I found it camping and saw men run across the river - COMPLETELY LIES.

I don't know if it would help or not but you might want to file a complaint with your local police department regarding the show and its portrayal of you. You also might ask them to occasionally patrol your neighborhood for your safety's sake.

If what you say is true, you have several legal options. I'm not a lawyer...but just think about it?

...you certainly have many different avenues to proceed in terms of violation of your privacy and property rights, without your consent.

Yes, I do want to talk to my neighbor to let him know that I did NOT say what the program claims is me.  It is clearly not my voice and it is clearly dubbed.  Anyone who talks to me can tell it isn't me.  Everyone here is watching the program because it was a big deal that Discovery paid to film in our county.  I drive a very recognizable vehicle and anyone watching who sees me drive by will know it's me!

The sheriff said the only thing I can do is message the detectives from that day and ask for the location.  I can also file an informal  complaint with the chief about what happened to me and how I feel like a sitting cartel target now, for some grow I didn't even know about!

I sent off a message to the detectives, chief and the Discovery producer who told me we would NOT be on camera and neither would my vehicle.  I asked them what they suggest for my privacy/security, let them know I am contacting an attorney, and mentioned in my PS at the bottom that the producer is a lying asshole.  (which did nothing but make me feel better....)

I'm very sorry you are going through this Shasta.  I love technology, and I know that this incident was the result of a major network.  I'm even more scared about how, these days, everyone with a smartphone is basically their own live TV broadcasting station.

Its getting harder and harder to get away from cameras too.  DW and I have gone to a couple of events where the whole thing was filmed, and simply attending the event basically meant you'd given consent to be used in any video without compensation.  While that may hold water legally, its a shame for those that don't want their faces plastered everywhere.

I also apologize for the anger at the word "sober" and "pissed."  I have English friends and I guess I should learn to use the word pissed-off.  And, it grates on my nerves that people who typically think nothing of drinking find medicinal or recreational marijuana to be so offensive...  It's a plant.  Get over it.

For me, this issue isn't a "weed or anti-weed" or even "cops" issue.  Discovery purposefully dubbed some other person talking over footage of my vehicle and made it look like it is me!  At the very beginning I say "Hi" and that is the ONLY thing there that is my actual voice!  It is total and complete fabrication.  And, it is clearly spliced together because the property they were looking for an owner for is NOT the property anywhere near my house.  They cut to a view of my truck (fake honking and all) and make it look like I am an informant! 

Watch the video.  I ain't got nothing to hide.  The FIRST thing I told them was not to film me or my teenager or vehicle and that I was not willing to be on TV and become a target.  I did actually say that.  They told me they were just shooting footage of the cops working and it would not show us or my car!

They show my truck again at the end right before the helicopter launches to go get the 2000 plant grow in the woods!  They again dub complete BS and attribute it to me!  (30.35 on the feed)  It says they "obtained information on a large grow" and cuts to my car again!

But the difference is that Shasta was filmed on her own property, she did not attend an event so there is no implied consent.

Right now, my employer does a lot of work in the community where pictures are taken of the patients treated.  Each picture that is used in our literature has a signed consent form attached to it.  No signed consent, the picture is not used.

Getting out of town is easier said than done with someone of limited means.
