Drug testing in most cases is not even a constitutional question. Whty? Because you have options. Take the drug test or not hired for a job or get government assistance. It is your choice.

Ok, so in this case the government is authorized to require you to take a drug test before you can get welfare from the government i am having trouble finding the amendment which allows government to search my person without probable cause. could you point that one out to me? Well, I would have to read the states individual constitutions to see if this violates some part of that, but as far as the US Constitution this would fall under the 10th amendment as the Federal Government has no authority to take money from one group and give to another. As far as violating the 4th amendment, it does not, since you are entering into an agreement with the government where you meet the requirements and they give you money, it is no different than having to provide proof of income and dependents.

It is your choice. wouldn't the same thing apply to genetic testing, or any other violation of privacy? let's say i were to tell to you that we require an anal probe before we will hire you. you certainly have the right to say no to the anal probe and keep collecting unemployment to your 99 weeks. but don't you also have the right to question whether or not it is a violation of your privacy rights?
