Bank of America Gets Pad Locked After Homeowner Forecloses On It Collier County, Florida -- Have you heard the one about a homeowner foreclosing on a bank? Well, it has happened in Florida and involves a North Carolina based bank. I don't know. If I thought about "bank foreclosure the fun way," it would probably involve explosives. It's not that I am a violent person (I made my DH remove the handgun from the upper bathroom cabinet that I am painting because I won't touch it), but I was figuring the bank would be foreclosing on me. I'd rather blow the house up first, assuming it wouldn't hurt anyone and it wouldn't in the rural place that we live. But the article was a nice sense of poetic justice. Just not my idea of "fun."

LOVE IT! Really stupid of the bank for screwing up so badly and then not immediately admitting they were in the wrong and cutting a check, I hope they got compensation for pain and suffering too!!!

That's an awesome story! I wonder how the bank even got their address or name if they paid cash for the house. It sounds like a lot of people forgot to dot their Is and cross their Ts. Good for the homeowner!
ETA: It's too bad the court doesn't make the bank pay for the court time and sheriff's deputy time on this. Taxpayers shouldn';t be footing the bill for their incompetence.

This happened because BOA wouldn't pay the couple's attorney fees. I hope that attorney charged a fortune, worth every penny he got from the bank.

Frankly, I'm amazed they got a Sherrif to go along with the plan! Sure they had a Court Order for the bank to pay. (Collecting a judgement is harder than winning the case.) But I would think they would have to back to Court to be able to get a lien on the property in order to really remove the bank's property.
As a landlord, when I have to evict someone, I have to pay a fee. This fee would include the cost of a Marshal going to the address and being there when I put the possessions on the street. I would assume they had to pay a similiar fee to pay for the Sherrif in this case.
Good publicity for the attorney! I wonder how many new clients he got after this stunt?
