The Supreme Court justice and his wife battled for years for a more conservative America. New reporting shows how far she was willing to go after Donald Trump’s 2020 election loss

The call to action was titled “Election Results and Legal Battles: What Now?” Shared in the days after the 2020 presidential election, it urged the members of an influential if secretive right-wing group to contact legislators in three of the swing states that tipped the balance for Joe Biden — Arizona, Georgia and Pennsylvania. The aim was audacious: Keep President Donald J. Trump in power.

The group, the Council for National Policy, brings together old-school Republican luminaries, Christian conservatives, Tea Party activists and MAGA operatives, with more than 400 members who include leaders of organizations like the Federalist Society, the National Rifle Association and the Family Research Council. Founded in 1981 as a counterweight to liberalism, the group was hailed by President Ronald Reagan as seeking the “return of righteousness, justice and truth” to America.

As Trump insisted, without evidence, that fraud had cheated him of victory, conservative groups rushed to rally behind him. The council stood out, however, not only because of its pedigree but also because one of its newest leaders was Virginia Thomas, the wife of Justice Clarence Thomas and a longtime activist in right-wing circles. She had taken on a prominent role at the council during the Trump years and by 2019 had joined the nine-member board of C.N.P. Action, an arm of the council organized as a 501(c)4 under a provision of the tax code that allows for direct political advocacy. It was C.N.P. Action that circulated the November “action steps” document, the existence of which has not been previously reported. It instructed members to pressure Republican lawmakers into challenging the election results and appointing alternate slates of electors: “Demand that they not abandon their Constitutional responsibilities during a time such as this.”

Such a plan, if carried out successfully, would have almost certainly landed before the Supreme Court — and Ginni Thomas’s husband. In fact, Trump was already calling for that to happen. In a Dec. 2 speech at the White House, the president falsely claimed that “millions of votes were cast illegally in swing states alone” and said he hoped “the Supreme Court of the United States will see it” and “will do what’s right for our country, because our country cannot live with this kind of an election.”

An aide to former President Donald Trump described a 2019 White House gathering with the then-president and Ginni Thomas, the wife of Supreme Court Justice Clarence Thomas, as the "craziest" meeting he'd ever attended, according to The New York Times Magazine.

Ginni Thomas — an attorney and conservative activist — has been in the political trenches with right-leaning leaders for decades. Her influence is so valued among conservative activists — and Justice Thomas — that she even came to the White House for what was supposed to be a private lunch between Trump and her husband, according to the magazine.

Leonard Leo, the former executive vice president of the conservative Federalist Society, told the magazine that Trump sought to cultivate a relationship with Justice Thomas once he realized the immense popularity of the jurist among the Republican base, creating an opening for Ginni Thomas with the then-president.

The magazine also detailed newly-reported ties between Ginni Thomas and organizers of a January 6, 2021 rally in support of Trump, along with efforts to overturn the 2020 presidential election results, in which Joe Biden oust the former president in a decisive 306-232 Electoral College victory.

According to nine former Trump aides and advisors, who spoke to the magazine anonymously, the ensuing meetings with Ginni Thomas created a sense of confusion among the staffers.

Several of the staffers were unsure of Ginni Thomas' role and wondered if she was speaking as an activist or as a paid consultant, while also highlighting her insistence on promoting far-right candidates for positions within the Trump administration, per the magazine.

"Here's what the peeps think," she stated in the meetings of the GOP base, according to an aide. "We have to listen to the peeps."

Ginni Thomas' hard-driving style alienated several of the aides so much that they assembled an opposition report on her, with one of the staffers describing her as a "wrecking ball."

In January 2019, Ginni Thomas met with Trump at the White House alongside select members of her conservative group, Groundswell, where a Trump aide described the nature of the conversation in unflattering terms.

"It was the craziest meeting I've ever been to," he told the magazine. "She started by leading the prayer."

Later, the aide said that conservative attendees spoke disparagingly of "the transsexual agenda" and parents "chopping off their children's breasts."

According to the aide, Trump "tried to rein it in" but "it was hard to hear" because members of the group were praying out loud during the conversation.

Later, some key details of the White House meeting leaked, and Ginni Thomas' advocacy against transgender rights made headlines.

In the past, she has used inflammatory language against transgender Americans, saying the country is under threat by the "fascist left," which she said includes "transsexual fascists."

In the meeting, Ginni Thomas and other attendees also lamented that several conservative candidates to their liking had been stymied from assuming several roles, while advocating for the Trump administration's personnel office to be swept of "Never Trump" Republicans.

I didn’t know anything about her until last year. From what I’ve read about her since then, I consider her and her activities to be a serious issue given who her husband is. Which means I really consider him to be a problem.

He’s recused himself 32 times in his 27 years on the court, but never once has he recused himself on a decision that his wife has been active on.

Good idea, but I don't think the numbers are there for the Senate. Still, he could make history for being the second SC Justice to be impeached.

The House needs only a simple majority to impeach a Supreme Court justice or any federal judge. To convict and then remove the justice or judge, the Senate requires a two-thirds majority.

Clarence Thomas needs to recuse himself from any and all SCOTUS cases involving the January 6th insurrection and investigations associated with it which results in criminal charges and convictions. 

It is not enough for Ginny Thomas to state "We have our own separate careers and our own ideas and opinions too,” she told the Free Beacon. “Clarence doesn’t discuss his work with me, and I don’t involve him in my work.”

The wife of Supreme Court Justice Clarence Thomas acknowledged for the first time that she attended former President Trump’s rally on Jan. 6, 2020, but insisted she did not join the attack on the Capitol that followed it.

Ginni Thomas, a prominent conservative activist in her own right, attended the “Stop the Steal rally,” which she framed as a righteous gathering of those concerned about the nation’s democracy, the right-wing Washington Free Beacon news outlet reported Monday.

“There are important and legitimate substantive questions about achieving goals like electoral integrity, racial equality, and political accountability that a democratic system like ours needs to be able to discuss and debate rationally in the political square,” she said. “I fear we are losing that ability.”

Ginni Thomas, 65, denied reports that she helped plan or bankroll the rally.

“I played no role with those who were planning and leading the Jan. 6 events,” Thomas said. “There are stories in the press suggesting I paid or arranged for buses. I did not.”

Ginni Thomas said she left early before Trump spoke due to the frigid weather. Despite saying she “was disappointed” at the violence, she avoided criticizing the mob of Trump supporters who stormed the Capitol.

“I was disappointed and frustrated that there was violence that happened following a peaceful gathering of Trump supporters on the Ellipse on Jan. 6,” Ginni Thomas said.

Trump and other MAGA allies egged on thousands of supporters at the rally to march on the Capitol to prevent Congress from certifying President Biden’s election victory.

The ex-president told his loyal supporters to “fight like hell” to keep him in power. Thousands of them marched to the Capitol, where they overwhelmed outnumbered police and forced lawmakers to temporarily abandon the constitutionally required certification.

The wife of one of the most conservative justice on the Supreme Court is an outspoken supporter of Trump and other far-right-wing causes.

But Ginni Thomas insists that her activism is unrelated to her husband’s role on the top court.

Virginia Thomas, a conservative activist married to Supreme Court Justice Clarence Thomas, repeatedly pressed White House Chief of Staff Mark Meadows to pursue unrelenting efforts to overturn the 2020 presidential election in a series of urgent text exchanges in the critical weeks after the vote, according to copies of the messages obtained by The Washington Post and CBS News.

The messages – 29 in all – reveal an extraordinary pipeline between Virginia Thomas, who goes by Ginni, and President Donald Trump’s top aide during a period when Trump and his allies were vowing to go to the Supreme Court in an effort to negate the election results.

On Nov. 10, after news organizations had projected Joe Biden the winner based on state vote totals, Thomas wrote to Meadows: “Help This Great President stand firm, Mark!!!...You are the leader, with him, who is standing for America’s constitutional governance at the precipice. The majority knows Biden and the Left is attempting the greatest Heist of our History.”

When Meadows wrote to Thomas on Nov. 24, the White House chief of staff invoked God to describe the effort to overturn the election. “This is a fight of good versus evil,” Meadows wrote. “Evil always looks like the victor until the King of Kings triumphs. Do not grow weary in well doing. The fight continues. I have staked my career on it. Well at least my time in DC on it.”

Thomas replied: “Thank you!! Needed that! This plus a conversation with my best friend just now… I will try to keep holding on. America is worth it!”

It is unclear to whom Thomas was referring.

The messages, which do not directly reference Justice Thomas or the Supreme Court, show for the first time how Ginni Thomas used her access to Trump’s inner circle to promote and seek to guide the president’s strategy to overturn the election results – and how receptive and grateful Meadows said he was to receive her advice. Among Thomas’s stated goals in the messages was for lawyer Sidney Powell, who promoted incendiary and unsupported claims about the election, to be “the lead and the face” of Trump’s legal team.

The text messages were among 2,320 that Meadows provided to the House select committee investigating the Jan. 6 attack on the U.S. Capitol. The content of messages between Thomas and Meadows – 21 sent by her, eight by him – has not previously been reported. They were reviewed by The Post and CBS News and then confirmed by five people who have seen the committee’s documents.

Meadows’s attorney, George Terwilliger III, confirmed the existence of the 29 messages between his client and Thomas. In reviewing the substance of the messages Wednesday, he said that neither he nor Meadows would comment on individual texts. But, Terwilliger added, “nothing about the text messages presents any legal issues.”

Ginni Thomas did not respond to multiple requests for comment made Thursday by email and phone. Justice Thomas, who has been hospitalized for treatment of an infection, did not respond to a request for comment made through the Supreme Court’s public information office.

No wonder Thomas voted against releasing some of Trumps records to the Jan 6 committee-he knew that could uncover his wife’s emails. Which means he knew the emails existed, despite his wife’s claims that they don’t talk business to each other.

Thomas needs to resign but he won’t. Nothing will happen to her either. I’m beginning to think the DOJ won’t move against any of these outrageous Trump era people for fear of looking ‘political’.
