We had a tough day in court today with the crazy ex-attorney who has dogged my husband for 12 long years. We had to hire a bodyguard for this one because of her aggressive behavior in the lobby of the court building at the last hearing. However, her case was dismissed, and we have now entered the penalty phase. She got into it with the federal magistrate today and really displayed her mental illness and egregious abuse of the court system with her eight or so lawsuits against my husband and his attorneys one by one, with announced plans to sue our current attorney as soon as this case is over for "misconduct". The magistrate had had enough, and flat-out told her he will be recommending injunctive relief to keep her from suing my husband and attorneys any further, plus our legal costs, plus fines, plus a requirement that she post a bond of probably $20k before she files anymore crackpot lawsuits. Her stated cause now is to overturn the witness immunity laws and take the overturning of something called the Rooker-Feldman doctrine to the Supreme Court, while of course needing my husband as a witness because "he is central, he is the key". We know, of course, that this would be laughed out of court, but unfortunately we're spending up to $20k a year to defend against her B.S., so needless to say, we were thrilled. I broke down in the elevator afterward. Her degree of mental imbalance and vindictiveness is ever increasing. When we got home, we both conked out for two hours because it was so emotionally exhausting. I'll be relieved when this period of our lives is over.

He hired her 14 years ago after his first wife had died to handle his father's estate and do his taxes. While he was then in the hospital a little later recovering from a heart attack and a quintuple bypass, she got him to sign a power of attorney form for his finances, and bilked him out of $100,000 in a loan for a building that she bought for herself while representing him. She also refused to give him a promissory note for the loan, always telling him that she was going to send it, it was back at her office, etc. His whole family had died, including his father and brother, along with his wife, and he was extremely ill. To make a long story short, she knew his assets and was systematically depleting them. She was also verbally abusing him in phone calls and letters and emails, and left threats on the answering machine of his first new attorney.
I met him and we started dating, and I soon realized what she was. A predatory bitch.... Anyway, the whole mess wound up before our state's attorney grievance board, and after four years of wrangling with them, her license was suspended and then permanently revoked, she did sign a promissory note for the loan, which she subsequently reneged on, he was subpoenaed to testify against her along with 7 othe attorneys, she's sued him, the entire attorney grievance commision, their lead investigator, and every attorney we've ever employed to defend us. And our little dog, too. Well, maybe not the dog. She's been up before our state's supreme court either three or four times that I know of. Now she's working her way though the federal courts. The whole thing is so bizarre that it would be rejected as a plot for a tv show, but it's real.
She always appears on her own behalf, and her goal is to break him. She's come close but has never succeeded. She's laughed when he's gotten chest pains, though. We're surviving.

Thanks for the support. We would have moved away long ago, but I have 6 1/2 years left in my job in order for me to retire with full medical benefits. I don't know what we'll end up doing. We'll see if the injunction quells her vindictiveness or not. If it doesn't, we'll probably go to a different state.

I hope you revoked the POA. Also look into a PFA order against her. It might help. Consider a countersuit to recover your expenses.

The POA was revoked twelve years ago. He did have to get a personal protection order against her years ago, so she has resorted to stalking him through the courts to get his attention and somehow remain part of his life. I do know that she considered him a "friend" while financially bilking him and "helping" him when his family was dying off and then during his recovery from heart attack/surgery. However, there was no love or sexual relationship between them; he is physically repulsed by women that have her physigomy. She has some fantastic need to track him, and let him know she's always out there. I've seen her try to get him so upset that he'll have another heart attack. It's so weird that she's sacrificed her career, her finances, and seemingly her common sense over these specious issues of him "deserting" her as a "friend." All the friendship consisted of was him hiring her to handle his father's estate, his wife's estate after she died, his taxes, eating lunch her a few times, and sitting with her at coffee shops while she maundered on. This was 14-15 years ago. You'd think that when he broke off their so-called friendship over the financial misdoing that would have ended it, but she took the next attorney he hired to our state's ethics commission, and that was the beginning of her legal troubles, because the second attorney had her grieved back to the commission herself, and that was when the investigation began. We considered moving, but we decided to stay and litigate, because she'd just track him down anyway, and Canada doesn't want older immigrants. We had considered moving there to get away from her. At the end of the day, I've told him she's got the equivalent of an obsession for him of the Fatal Attraction type, and there's no getting around it, although it's not of a sexual nature. Aside from all of the expense and worry she's caused us, there really is no other explanation that we can think of. Of course, all that is combined with a failed legal mind that knows how to file very bad briefs, and some serious dementia which seems to be coming on. We don't know.....

We are getting some money from the foreclosed office which we sold on a LC, but due to remodeling costs because she wrecked it, we did take a loss on it. We got a great tax refund this year.... We also know where she banks and what car she drives, so we may be able to get liens put on her accounts and her car. We're going to have a search done to see if she has any other brokerage accounts, bank accounts, and real property. We should get a final decision from the federal court in one to two months, from what we understand. That will give us the go-ahead to begin these proceedings, since the magistrate already stated that there would be both monetary and injunctive penalties for her. We'll have to see wht will come out in the wash on any repayment from her, though.
