I have some questions regarding the SOL of limitations for the 2007 tax year. If you filed an extension so that your 2007 taxes was due 10/15/08 but you haven't turned them in yet, does that mean your last chance to get a refund for that year is 10/15/11? Or is it 4/15/11? Also has anyone ever had a problem with the IRS claiming that you didn't have an extension for a tax year when you did in fact have one? Would if you don't know if you've lost the documentation that you had an extension?

If the IRS says you don't have a valid extension and you cannot prove them wrong, then you are toast.

is the internet confirmation # enough to prove extension? If you filed extension electronically in past you will have no USPS records.

I'm not sure what it takes. The IRS has never challenged an extension filed by me.

if you have access to your transcript from the IRS it will indicate if an extension was timely filed.... I often check this for my clients who procrastinate that long....
an electronically filed extension is given a document number by the IRS (like a "confirmation" number), if you have this record and it is time stamped on or before the original due date (and it was not rejected) then you should be good..

thank you for the replies. I have an extension on file for 2007. Does the 10/15/11 deadline for 2007 refunds also apply to things like the earned income tax credit or recovery rebate? Or does a 2007 EITC have a 4/18/11 deadline?

the actual extended due date for amending a return for 2007 is April 15, 2011 (if "timely" filed) or 3 years from the date filed, which may not necessarily be October 15, 2011.

What if the 2007 return was not filed at all yet? So it wouldn't be an amendment. An extension was filed April 2008. Is the deadline for 2007 EIC 10/15/11 in this case?

There is a three year statute of limitation on claiming refunds of overpaid taxes whether a return has been filed or not. That includes applying a overpaid amount as a credit to the next year's taxes.
