Englander Henning found that Peterson had a duty to the school community as someone whose job was security and who had an “obligation to act reasonably” under the circumstances of the shooting. The judge also found Peterson was not protected from the lawsuit by “sovereign immunity,” a legal doctrine that shields public employees from legal action based on their official conduct.
Joel Perwin, Pollack’s attorney, said: “We don’t think it's even debatable that Peterson had a duty to these students. Peterson’s disclaimer of any legal responsibility is a mirror of his abdication of his responsibility for these kids,” he said. Peterson’s lawyer, Michael Piper, said he would appeal the ruling.

They said it is because the students aren't in custody like prisoners or patients of a mental hospital. I would argue they are in custody. Students are required to be at school at particular times of the day and to follow the direction of school officials. I think this one is going to a higher court.

Plaintiffs refile naming him and the city department and the insurance companies pay the piper.

Sounds real world reasonable to me. Agree. My take is the police officer has no financial money (deep pockets) for the plaintiffs to garnish, but he works for a city department-the police department. Plaintiffs refile naming him and the city department and the insurance companies pay the piper. If there are enough successful lawsuits that insurance carriers have to pay, maybe they will lobby for better gun control.
