Extraordinary manipulation by powerful people led to the creation of Robert Mueller’s continuing investigation and prosecution of General Michael Flynn. Notably, the recent postponement of General Flynn’s sentencing provides an opportunity for more evidence to be revealed that will provide massive ammunition for a motion to withdraw Flynn’s guilty plea and dismiss the charges against him.

It was Judge Rudolph Contreras who accepted General Flynn’s guilty plea, but he suddenly was recused from the case. The likely reason is that Judge Contreras served on the special court that allowed the Federal Bureau of Investigation to surveil the Trump campaign based on the dubious FISA application. Judge Contreras may have approved one of those four warrants.

The judge assigned to Flynn’s case now is Emmet G. Sullivan. Judge Sullivan immediately issued what is called a “Brady” order requiring Mueller to provide Flynn all information that is favorable to the defense whether with respect to guilt or punishment. Just today, Mueller’s team filed an agreed motion to provide discovery to General Flynn under a protective order so that it can be reviewed by counsel but not disclosed otherwise.

This development is huge. Prosecutors almost never provide this kind of information to a defendant before he enters a plea — much less after he has done so. This is one of myriad problems in our justice system. As Judge Jed Rakoff wrote several years ago, people who are innocent enter guilty pleas every day. They simply can no longer withstand the unimaginable stress of a criminal investigation. They and their families suffer sheer exhaustion in every form — financial, physical, mental, and emotional. Add in a little prosecutorial duress — like the threat of indicting your son — and, presto, there’s a guilty plea.

Mueller's desperate rapid-fire indictments on the fringes of the Russia probe include some obscure London lawyer for lying about a case having to do with the Ukraine-- and get this: one of the things he's accused of doing? Deleting emails.

I don't think so.   The articles say, "it's in the works."

Flynn would not have pled guilty so early in the game unless there was something against him.    It sounds like the feds had the easiest route to trapping him, got him good, and then used him to get to the others.  Standard investigatory procedure.    Drug busts, money laundering, they all work the same.    If he does withdraw his plea, whatever guaranteed sentence he had is out the door, he goes to trial, and if he loses, he gets hammered.  

His lawyers won't file this motion unless they get him to consent, in writing, to it, with a full explanation of the consequences. 

Most of the time, the guy will file the motion on his own, or will find a new lawyer.     Because they guy told the first lawyer he did it.  

As for the governmental misconduct, it happens, and happens a whole bunch.   But in this high profile case, the prosecutors and investigators are paying close attention.   They don't want to be publicly embarassed.

But as I understand it, people frequently plea to the smaller charge instead of facing a bigger one... so even if he could have defended against the lie charge to a reasonable doubt, it’s not likely that charge he was really worried about...

I heard today that Trump is hugely jealous of Obama, because of his popularity and the way his admin didn't keep shooting itself in the foot and ending up splashed across the headlines every damn day.

I did not share this initially because I wasn't sure if this bombshell was legit-- and admittedly, Trump has passed on some questionable information via his Twitter account in the past. My suspicion was that "Rob Goldman" here wasn't the real Rob Goldman, or that he wasn't FB VP of Ads.

It was also made clear that the object was not to help Trump. The object was to create chaos and sow discord-- in other words, there's functionally no difference between Russian troll farms and Democratic campaigns.

This appears to be a remarkably stupid uneducated opinion. Christopher Steele was hired to write part of a dossier, not to influence an election. Campaigns apparently buy opposition research and some of it might be from non-Americans. It appears that is a legal practice.
