My UE appeal hearing is set for Tuesday morning. I have all of my paperwork and notes together.
What should I expect to happen?
Win or loose the appeal, I will accept the final decision and know that I may have to file an amended tax return (efiled yesterday though a tax person - and they were aware of the upcoming appeal.)
The temp service that said I quit, recently started to contact me and actually got me a position that I start on Monday. I had to re-sign new applications and when I was told of this, the woman at the temp agency said that they already had a "short app" but needed the long version.
Both women that I have dealt with at the temp service have been very nice and I don't want to make them sound bad so I'll just present my side.
I did ask for a copy of the new application and their monthly contact info is on it.
Again, not looking for right or wrong, just what to expect. My nerves are frayed new job, appeal and all.
Thanks,

I've been there and won. At least in my state, the side that fights the longest, wins. I've got a buddy who is an employer. His view is that the employer always looses.
Remember, they are mindless government drones. All they hope for is to know which box to check (approve/deny) with as little brain power as possible so they can get back to their next coffee break.
Just look for the brass ring. Tell them what they want to hear. You were let go for lack of work. You followed up there (and other employers) to find more work. They should check the "approve" box.
When I appealed, I got one lump sum check. Which was quite nice seeing as I was already employed when it arrived. Talk to your tax person. I'd guess a check received in 2011 would go on next years taxes.

The only leg I have to stand on is that they never gave me a copy of the papers saying that I had to maintain monthly contact with them. That and the fact that I thougt it was a one time thing. It was a funded position that I applied for directly through the company and then got refered to the temp agency. I did sign paper with them and still don't have copies. The job lasted 8 months and until they denied my claim was over a year from when I signed anything with them. The handbook states different information alltogether and I know that those can be changed on a whim - but the new book they gave me is the same as the old.
Either way, I'll accept the decision. I go back and forth on being confident and not.
Will it just be myself, the referee, and the temp service rep? I realize it won't be like a court hearing. All of my paperwork is in order and ready to go.

Kate, Are you saying that you are presently collecting UE and your pervious employer is contesting that you quit but also offered you another job? That's wierd to me. I only know one person who ever filed for UE claim that the employer contested. They said they were fired because of a disagreement with their manager over a project. The employer later tried to say that is was so bad the employee shouldn't get UE. The employee contested that obviously. The appeal wasn't as formal as your OP talks about. It was just a person from UE calling both of them and asking some questions. It was pretty easy. They just ask what happened and stuff. The employee won as the UE person believed that they had not been fired for cause. some one also told me that most of the time only one party will actually make the time to answer the apeal meeting. Whoever shows up wins. So make sure you show up.

973 - they have put a hold on my UE until this is settled and I may have to pay back what I have claimed since October 1st. UGH...
Yes, the same company just placed me with another job after calling me for several weeks in a row. This is after the appeal was filed. The UE office was surprised that this company was trying to get me a job as well, but said to see what they had to offer. It worked, I guess.
The new temp service handbook as well as the old says that if I quit, then I would not be considered for re-hire?! But THEY made contact with me after saying I quit and got me a job.

Kate if I were you I wouldn't get into too much info. I would just state this. If you were hired by the original company for a contract of 8 months. UE shouldn't have a problem with that.
I would say the agency wanted to hire you again. Then the onus is on them to produce evidence that they had a contract with you and you voluntarily quit.
Good luck!

Only answer the questions asked, present your documents and don't volunteer anything.
I was lucky. My "appeal" was over the phone and previous employer game in because he didn't have his facts straight. He said I had worked on a Saturday outside of tax season and it wasn't true. End of discussion. He lost his credibility with the UE examiner.

Does anyone know the difference between loose and lose?
I'm going to lose my job. I have a loose tooth.
Not to be the spelling police but those two get mixed up on this forum ALL the time.
