That's an awful story. I hope a lawyer can get at least a reduced fine for not filing whatever it was in a timely manner. $30K is ridiculous for a child already of age who had the real father in their life.

Judges need to stop ordering child support for children not fathered by the man involved.

So it sounds like both sides are claiming they did their part. The court claims it made Mr. Alexander's responsibilities clear and he failed to meet them. Mr. Alexander admits that while he didn't file the motion, he indicated at each juncture that he was not the child's father. I'd like to believe that with proof Mr. Alexander is not the father, that the case can be dismissed and the charges dropped. However from a legal perspective, does the letter of the technicality hold Mr. Alexander to the punishment? ...:::"“I am outraged at the media for the willful misrepresentations of the facts of this case,” said Judge McCarthy. “Casting this court in a negative light.”":::...

Wow. I feel for the guy and hope his lawyer gets it overturned. I see how he got into this mess, lacking the money to hire a lawyer to defend against it and not understanding what needs to be filed. He was also unaware of the problem for years, as it has been proven that he was in prison when he was supposedly served papers at an old address.

I can see how having to get a lawyer/ track down the mom/ pay for DNA tests etc could be a financial burden for some. Seems like Mom should be the one who has to provide the burden of proof who the dad is, when mom isn't married and the man she claims is the dad contests it. I don't understand how mom just gets to point out the dad and no one asks for any proof of that claim.
This all comes down to money. If I'm not mistaken, once the father pays child support the State will take a piece of it to help off set any benefits they have provided to the kid, over the years. I don't blame them trying to collect it, they just need to make sure they collect it from the sperm donor - especially since the sperm donor has apparently been in the kids' life as his dad for all these years.

The mom was his ex. Depending on when they got divorced, I can see the presumption being that the baby was conceived before the divorce was finalized.
But this is still so wrong. Innocent people shouldn't have to bear the financial burden of proving their innocence to the extent here. He should have been able to say he was not the father, and the dept. trying to collect child support request a paternity test.
But that would be too simple.

Why do I think a simple episode of Maury could handle this?
And that judge needs to be taken off the case, she sounds incredibly prejudicial towards the defendant.

I somewhat understand the judge's point about him not doing something about it sooner... But then again why should he have the burden of proof? So anybody can write down whatever name they please? If i have any more kids, i'll be sure to put Donald Trump as the father!

The guy was in jail at the time when the child was conceived. At least that's what I tought the article says. At the time of his release he found out that he was put down as the father in the paper work. This to me looks like vengeance against men proliferated by a woman judge that had a bad experience with men. Wouldn't be the first one!
