Any bets the DOJ is not going to institute an investigation into whether the assault constituted a violation of his civil rights, or a "hate crime" by the hysterical gunphobe?

Some people get nervous- can you blame them when people DO shoot people in Walmart, food courts at the mall, in hospitals, etc?

The smart thing to do when you suspect someone may be up to no good would be to call the police and maybe keep an eye on the guy.

According to paul, this should be a violation of the gun owner's civil rights and a "hate crime".  Violations of another's civil rights usually ends up with some type of criminal charge.  The tackler has been charged with battery so that issue is taken care of.

As to it being a hate crime:  how is it a hate crime under federal or Florida law?

You misunderstand. The victim was the gun owner in this case.

He was one tackled and pinned down. Then when the police showed up, the police hauled him (the gun owner) away in their cruiser. I'm not sure if he was arrested or not. But the point is that the boys in blue dragged off the wrong man in this case.

I suppose if guns make you nervous, it'd be a relief to see police pull a man with a concealed weapon out of a store even if they had no lawful basis for doing so. But all this case proves is that some cops apparently don't care whether citizens are licensed to carry or not.

You're right: Call the police and report what you observe and let them sort it out. I fail to see a situation where tackling a person who is otherwise not behaving suspiciously for having not properly concealed their weapon.  If you absolutely must confront them, just let them know- I can see that you're carrying a weapon, you need to conceal it.  I live in Florida, it's tough because we don't typically have enough clothes on down here to properly conceal a weapon.  I've said something to people before- just to let them know.  One guy showed me a badge, and said thanks, but I don't have to conceal it. Fair enough.  Just trying to help.  Imagine if I'd decided he needed to be tackled and restrained?

You keep repeating the same thing. The tackler has been arrested for battery. People violating someone's civil rights should be charged with a crime. So that is taken care of. What more do you want?

What basis do you have for a hate crime charge? If it is true that the tackler is white and the person carrying the gun is black, you might have a hate crime based upon race. But was it white bias toward blacks or was the white guy thinking the black guy might have wanted to rob the store?

Then he'd have a gun, and that would make him not such a stupid idiot to do something like this in the first place.  Frankly, he's lucky he didn't get shot himself.  You guys make fun of me for taking self defense classes, but a lot of it is dealing with situations where someone gets the jump on you like this guy, and maybe not last year, maybe not even three months ago- but today, I'd probably be able to render an assailant unconscious pretty fast.  Whatever doesn't kill me, had better start running.

That doesn't make it concealed anymore! Unless there was in the respective state an "open carry" policy in place then I see why he tackled the other guy. If you carry a concealed weapon- key word concealed- nobody and I mean nobody should see it. Or just stop carrying a concealed weapon if you can't hide it well enough. Otherwise you risk being tackled and next time might be the cops throwing you on the floor and pointing a gun at you.

I looked up the definition of "concealed" in regards to weapons and yes, the man was good!
aparently it doesn't have to be completely out of sight, just tucked under.

As a result yes, I understand why the tackler could/should be charged.

The weapon wasn't drawn, and there was no behavior to warrant being tackled.  However, the truly egregious behavior was continuing the attack after being told repeatedly by the victim that he had a license to carry.  This is a simple case of an idiot gun-phobe out of control.

They also take away Daniel’s holstered firearm that was under his shirt. Then, Foster calls 911.

As I've said before- when you are armed, there's always at least one gun in the mix. Going for it makes the assailant armed no matter what people want to blather on about assailants being "unarmed".  It is absolutely grounds to shoot someone, and I wouldn't hesitate if I had the opportunity to put a slug in someone that grabbed for my gun.
