Remember this story? Her family wants her declared alive so she can be returned to care in California "Jahi could return from New Jersey, where she is being cared for by her family, and her costs for care could be shifted to the state of California or possibly to Children’s Hospital. "
2. She is currently being cared for in an apartment, not a medical facility. 3. Her lawyer presented testimony from 5 doctors that she was not brain dead and 2 videos allegedly showing her moving her toes and arm on coaxing by her mother Videos here: blog.sfgate.com/stew/2014/10/03/jahi-mcmath-videos-released/(Note that while these are supposed to be current video there is a Mother's Day poster up and Jahi is still in a medical facility.) 4. Court appointed expert (Paul Fisher) says these 5 doctors used standards and tests that are irrelevant. This is the same expert that declared her brain dead in Dec. "Fisher, in his letter to the judge, said the new test was performed in an apartment, not a health care setting, and the recorded activity could have come from elsewhere in the girl's body or even the environment. Regardless, he said, a flat reading on the exam is not a prerequisite for brain death. Fisher similarly took issue with the brain scan that allegedly showed blood flowing to Jahi's brain. He said the test doctors and researchers from the nonprofit International Brain Research Foundation used was incorrect and would not have demonstrated such blood flow." 5. McMath lawyer says that "Fisher has a conflict of interest because he was one of the physicians who agreed with the brain-death diagnosis in December." 6.Further hearing currently postponed for family to seek time to respond to Fishers findings.

Probably because no licensed medical facility will (or could?) care for a deceased person.

I don't remember this story previously. Did the family want her 'dead' before? Or did they just lose the first time around & are trying now to change the ruling on 'dead' vs 'alive'?

Probably because no licensed medical facility will (or could?) care for a deceased person. Bingo. According to *any* insurance standard, there is no "care" for a dead person. She was declared legally dead before she was released to her family. As far as the hospital was concerned, they were releasing a dead body to her family for burial - and the courts upheld their contention.
The family is probably strapped for money for her on-going care, and are maneuvering (working to "have her declared alive") to shift the burden of the cost of her care back onto the State or the hospital.

This case crossed my mind recently. What condition is her body in at this point? Especially since she isn't in an actual medical facility.
I understand loving someone, especially a child so much it hurts and you just don't want to let go.
When will they see it's time?
Best case scenario, I'm wrong and she wakes up someday and says "thanks for waiting." I don't see it happening.

I read somewhere she was in a Catholic Hospital in New Jersey. I'm going to have to do some looking around to confirm that, though. The pictures I've seen show someone in a hospital, not an apartment. If that poor child is being cared for in an apartment, either the family couldn't afford to keep her in the hospital, they didn't agree with the hospital's decisions for treatment (again), or they decided they could make her a DIY project. Any way you look at it, it's horrifying!

Last December the child had a complex tonsil surgery. She bled in recovery and complications caused a lack of oxygen to her brain. Despite having 5 experts declare her brain dead, her family refused to let them remove her from the ventilator. A judge would not force the family to let the hospital to take her off life support. A deal was reached where the child was declared legally dead, but the family could take possession of her. She was transported out of California at that time.

'Winner'-the girl went into cardiac arrest at the dentist office but was revived. Unfortunately she went without oxygen too long and was declared by multiple medical experts as brain dead but the family was fighting the powers that be to keep her on life support. At one point, medical experts stated her organs were rotting inside of her. Long drawn out court case but the family was able to take her into their own 'care' with the money coming out of their pocket. I may have a thing or two wrong, but that is it in a nut shell.

You'd think there'd be a good reason why she was no longer at that medical facility. Maybe the body was decomposing enough and they made the parents take her away?

And call me cynical, but I can't help wondering about the timing of this. California has Prop 46 on the ballot in four weeks that would increase the cap on non-economic damages that can be assessed in medical negligence lawsuits to over $1 million from the current cap of $250,000. Jahi McMath family's lawyer has been a big supporter of this legislation. Even though I don't think it would effect the McMath case, bringing her story back into the spot light at this time seems calculated. ETA: And I think the money on GoFundMe had starting drying up. I looks like most donations stopped about 3 months ago until this was in the news again recently. www.gofundme.com/Jahi-Mcmath

There isn't enough research on this sort of thing to know, thyme. With blood pressure support and hormones to keep the organs functioning, along with a ventilator, a body will continue to function. For how long is not known, to my knowledge.

She died after surgery - she was not at the dentist. About her rotting from the inside...they keep people in comas for a long time, would the same care keep a dead body in the same condition? I postulate that maybe it is a dead person, not a dead body. Quite creepy.
But hey- why not have the underlying fight about it- we still can't agree when life begins so why would we agree when it ends?
She has a beating heart- just like a fetus- in fact she is much more alive than a fetus by all measures- so why no support? Where are the pro-life people now? She needs a ventilator to live- a fetus needs a mother to live.
She is a religious lady- and still no support from the pro-life community. I smell the stink of hypocrisy yet again.
Those assholes will gladly shut her machine off, yet prevent someone living a nightmare from ending their own lives, because according to them God decided that living in an institution as a meat puppet is sacred regardless of what the person wants.
