This evening my husband and I were having dinner at restaurant that is part of a residential/marina complex. As we were leaving the restaurant, I looked over the elevated balcony and saw two people in a pool having, what appeared to be, sex. I asked my husband if he thought they were having sex and he said: Yes, and we should go. As we were walking down the stairs to get to the parking lot, I yelled "we can see you" to the couple having sex. My husband became upset at me for doing that. I also saw a woman at the bottom of the stairs and asked if she thought the couple was having sex in the pool. Apparently she was unaware of what was happening, so she went upstairs to check and then confirmed that the couple was indeed having sex. My husband and I walked to the car and I could tell that he was upset with me.
He feels that I caused a scene. I correctly told him that it was the people in the pool that caused the scene, not me. He thinks that it was inappropriate for me to: (i) tell the couple that we could see them, and (ii) ask the woman at the bottom of the stairs if she saw the couple getting it on as well.
People were going in and out of the busy restaurant and if anyone looked down, this couple, which was about 50 feet away, would have easily been seen. The couple had absolutely no care that what they were doing was completely indecent in public!!! We left the restaurant around 7:20 pm EST, so it was not completely dark. I’m not sure if the couple started having sex when it was down pouring a few minutes earlier (as no one would have seen them) and just had not finished by the time we were leaving. In any event, it was inappropriate.
If my husband wasn't getting so upset with me, I probably would have called the police. What would you have done? My husband feels that I should have left it alone because it is possible that no else would have seen them, if I had not “caused a scene.”

I don't know. Depends on what you want to do. Sometime getting upset by other idiots isn't worth ruining my night so I just let things go. Even though it was annoying, your DH was actually more upset by you taking more notice of it rather than fluffing it off so in that sense, I guess maybe it wasn't worth the angst. On the other hand, that is pretty rude but really I doubt that anyone noticing or yelling was going to make them stop. Maybe a call to the police would have been in order.

I would have yelled, and then laughed. Maybe if I was tipsy I would have stopped to clap and holler until they noticed. Or there's good odds I would have just laughed and kept on walking.

I would probably have ignored what I saw - or informed a staff-member of the marina/restaurant that there was a "show" going on in the pool for all to see.
What I WOULDN'T have done, is what you did - yell out to them, or speak to another patron to check on them to find out if you saw is what she's seeing.
I'm going to side with your DH on this one - it was not your place to shout anything to them, or the ask other patron to have a look-see - you could have exited the restaurant and gone your merry way.
(With an opportunity like that, I might have commented that it looks like the water is cold. )

If it was in area highly trafficked by children, I would let someone on the staff know ....quietly. Else, I would comment to my spouse, laugh, and move on.
I would NOT go...OMG, stranger I'm bumping into! Look over there at that thing no one should have to see!

Stumbled upon some people having sex on our dog walking beach. Fortunately we had not yet let the dogs off leash or it might have been more eventful. It was a fairly secluded beach so I guess they could have expected privacy. We just turned around and left..then ran into a naked person on a bike..sooo..not sure what was going on there, but we figured no one would ever want to borrow that guys bike. We had a good laugh.
I wouldnt' make a big scene or a deal about it. I'd just leave the area so they can have their moment. Definitely would not have yelled at them or sent a stranger to gawk.

I hate tacky scenes! Being raised in the city, I probably would've yelled something like "I didn't pay for dinner AND a show". If I had kids with me, I probably would've called the cops. I wonder if filming the "scene" on my cell phone would make them stop, or encourage them (evidence!).

I'm pretty repelled by people putting their private business in public in any form, but I would have just walked on by. I probably wouldn't have said anything and I certainly wouldn't have felt it necessary to point it out to a stranger. I'm not sure I understand being offended by something and then calling attention to it to anybody who is around. People who do things like this is public probably want the attention and you gave it to them.
I may have laughed, tho. I can't help but laugh sometimes when people are being kinda dumb.
