This happened in school and is so wrong in every way that I can't wrap my head around it. Poor kid and WTF were these people thinking and why is this boy still allowed in school?! A law suit is not even debatable in my opinion and if I were the parent of the girl I'd want heads rolling, jail time for those that allowed this and major firings. Here is part of the story with the link at the end. (CNN) -- It's an unimaginable horror. A 14-year-old girl with special needs allegedly was raped at school after a teacher's aide persuaded her to act as bait to catch an accused sexual predator, a fellow student. "It has essentially devastated her life," attorney Eric Artrip -- who represents the girl and her father -- said of the alleged January 2010 incident. The Department of Justice and U.S. Department of Education filed an amicus brief Wednesday supporting her family's federal lawsuit against the Madison County School Board in Alabama. An amicus brief is a legal argument offered to the court by someone who is not a party to the case. The U.S. Court of Appeals for the Eleventh Circuit in Atlanta will decide whether to accept the argument. "School administrators knew the student's extensive history of sexual and violent misconduct and were alerted to the substantial risk he posed" to other students, according to the brief. About a week before the alleged rape, Sparkman Middle School vice principals Jeanne Dunaway and Teresa Terrell received a complaint that the boy had touched a female student inappropriately and was assigned in-school suspension, according to federal attorneys. A few days later, June Simpson, a teacher's aide at the Huntsville-area school, told the principal, Ronnie Blair, that the boy had "repeatedly tried to convince girls to have sex with him in the boys' bathroom on the special needs students' corridor" and had actually had sex with one student, according to the brief. The boy and his alleged sexual partner denied having sex in the bathroom, but Simpson recommended the boy be "constantly monitored," according to the brief. Blair said the boy could not be punished because he had not been "caught in the act," the brief reads. School policy requires allegations of student-on-student misconduct be substantiated. How is no one charged for this? Outrageous! Negligence, endangering a child, coconspirator to a rape, something. Unbelievable that this could happen and virtually nothing happens while the girls life has been ruined.

Holy shi+! Wrong. Just plain wrong! I want to go pound on the perp myself! -Maybe the aide that suggested it too. It's disgusting. Even if the aide could guaranty someone would be watching, her 24/7, to keep her safe, it was not her place to make that kind of suggestion. I hope the girl gets lots of help and support.

If that was my kid I would be down at the school with a baseball bat. The bastard who raped my kid would be dead along with the teacher's aide.
Then I would proceed to sue the school system until there wasn't a penny left no matter how long it takes.
It amazes me how STUPID people can be! You shouldn't use anyone as bait to catch a molester/rapist, but to go a step further and use a child who has no way of defending herself because she's special needs? I hope the devil saves a seat for this teacher's aid right next to the rapist.

She makes beautiful baby girls and that is such a sweet picture! I usually don't read very often over on the baby thread. I'm always afraid I'll get pregnant. That's how you get pregnant, right? This is wrong and the teacher's aid should be held accountable but there is not a lot of reporting on the boy involved.
What is his IQ level, is he able to be charged with a crime? Is he capable of understanding he committed a crime? How old is he?
It's a very twisted situation. Can the girl hold her own on a witness stand? If not, then how will they be able to convict the boy? No conviction = no crime and nothing the school can use to keep him out other than he said she said.
We had a situation like that locally where a boy raped a girl at a HS (only HS in the area). Neither kid was special needs though. The boy's father refused to move him to another school so the girl was forced to face her attacker every day until trial. Of course he had friends who were harassing her until she, the victim, had to change schools.
Just bad all around.

The school can't do a damn thing to get rid of these students. Even criminal students are entitled to an education.
