Obviously, Cathy Young thinks this is a Bad Thing. But is it the case that an epidemic of campus rapes makes explicit affirmative verbalized consent a compelling interest for the state? Or is it the case that an officious definition of consent between adults makes statutory 'rape' on campus unavoidable?
As the bill defines it, an entirely consensual encounter in which the male partner did not continually ask "is this okay? How about this? How about this? Was that your finger?" might meet the definition of 'rape,' with all the negative consequences that attend that label. Is that either appropriate, or at least an acceptable price to protect the unknown multitudes of women who don't report date rapes because the standards of evidence are prohibitively high?
