The DC Circuit rejected the IRS' appeal of of the district court's overturning of RTRP requirements. As did the district court, the circuit court ruled that the IRS exceeded its authority in making the regulations.

Congress needs to act here.... Some basic competency should be required.. Continuing education should be required....

Ditto the above. Note that it is not the PROFESSIONAL organizations, e.g. AICPA, ABA, EA organizations, that is opposed to the regulation of paid tax return preparers, but the NON-professionals. Every state that I know of has regulations for the practice of accounting and they include tax preparation, advice, planning, etc. in the practice of accounting. If the IRS and/or the Treasury Department do not have the statutory authority to regulate the paid tax return preparers then Congress needs to provide these agencies with the authority. The standards for the EA should be the minimum required, period. These 10 week wonders need to be eliminated from the practice.
