Could the "firecracker" hurt one, two, twenty or more if placed in the right location? Boston Marathon bombs for example.

I agree- whether something is a WMD is highly dependent on what you plan to do with it and where it is.  I have blown up plenty of things as a kid, made molotovs, huge firecrackers, dumped out gunpowder from shotgun shells to make more explosive fun, muriatic acid bombs, tennis ball cannons, you name it.  Worst thing I ever blew up was a mailbox- which is a felony I am sure- well, deformed and blew the door off of one
