Ever get someone evicted in 8 days or less? Every case I pull up seems to take AT LEAST 30 days. I've never heard of it taking less than two weeks. Working on something here at work and I think they are lying, but wanted to be sure.

Working on something here at work and I think they are lying, but wanted to be sure. No, because in NY you have to give the person a 30 day notice. Then if they don't leave, then you have to prepare a petition, the hearing has to be between 5 and 12 days of filing the petition. Yes, they are lying. What some landlords do is offer the person $500 to leave by the end of the month and leave the place clean. cheaper than doing an eviction.

I think there is something like a three days notice to vacate for not paying rent. However, I don't belief that the LL can kick you out after those 3 days. I guess at that point the LL could start proceedings to get you out? The LLs on YM know a lot more, but if I were guessing then that's what I would think is going on

I think there is something like a three days notice to vacate for not paying rent. The three day notice says "get out or we are going to start eviction proceedings" which start with the above referenced 30 day notice.

My boss keeps filing to evict his tenant and every time it takes longer than 8 days (I think 30, but I don't know) ... and then the tenant shows up at the court hearing with the money so my boss can't evict him! Then the cycle begins again. It is pissing my boss off like crazy.

I think it was a 2 year lease from like Aug 2012! The renters have been behind since pretty much day 1. My boss won't renew it. He's going to sell the house probably next spring. I think he was planning on holding onto the house until his kids were in college, but this renter has made him change his mind.

Can he evict on grounds other than rent? Has he checked for other lease violations? I really don't know. My boss (owner of the company) tries to keep most of it out of the office, but the tenant has a habit of showing up at the office. The only reason I know anything about it is because the tenant has shown up at the office. If the tenant never showed up or called during the work day, my boss wouldn't go on a rant about him as soon as he leaves. Occasionally, our office manager will take care some rental related items, but only rarely.

You don't file for eviction until the 5 days passes and they don't pay and they don't leave. In my experience it takes about 45-60 days from filing date to get to eviction, which is why we only wait a few days to serve a 5 day notice. 5 day notice excludes date of service, weekends and holidays. Once they have been served quit pay notice 2-3 times in my state you can serve the 3 day notice with no option to cure (pay rent and stay). Your boss may want to consult with an attorney if he wants the tenats gone.

Nope. Can't really give the details, but the landlord is lying to me about when the tenants will leave. If the county has no record of an eviction yet I don't think they are leaving any time soon.

Well it's possible that the tenants would "quit" the premises after being served a 3 day notice. Technically here if the tenant doesn't pay within the 3 day period and "quits" the premises (moves and returns the keys) the lease is canceled. Rather than pursue an eviction process we would pursue a breach of contract in small claims court if the LL has possession again.
It's rare but it does happen from time to time.

I am guessing if they were really gone, he would have agreed to our request to do a premise visit to verify & turn on for him He said they weren't out yet but had to be soon. Uhh huh, sure..... I've work with landlords on evictions all the time. Tenants leave a mess with the utilities too, especially when they tamper with the services. I've just never run across someone who was kindly "letting" the tenants stay through the end of the month but claims to have the formal eviction process started. Especially when I can't find verifiable proof.
