My thought is that the woman who pulled it out of the trash will ultimately get the winnings.

A judge may say who gets the winnings but my guess there won't be anything left after all the lawyer fees.

The judge ruled in favor of the original purchaser. The owner of the store is appealing saying that they are rightful owner of the ticket because the original owner threw it away and at that point the trash belonged to her.

So we have 3 people claiming the ticket? 1. The woman that bought it and discarded it because the machine said it wasn't a winner. 2. The store owner who says all discarded tickets are property of the store and employees are not to take them from the discarded trash. 3. The women who picked up the discarded ticket (along with many others) and has claimed the prize and spent part of the money.
What a mess.

What's crazy is there seems to be doubt if the original purchaser is actually the woman the judge is awarding the money too. She did not even enter into the lawsuit until the judge indicated it may be hers. To me, the store clerk is beyond greedy. Even if trash thrown in a trash can becames the store's property, an employee would have no claim to it, only the store owner.

I was also wondering what people's thoughts would be on this story. I was wondering how the original purchaser can prove it.
Also, did the lady who got the ticket out of the trash brag about finding it or something or how did they know she got it out of the trash?
I think this is a "finders keepers losers weepers" kind of case myself (or maybe I just spend too much time around kids).

I'm confused on why the ticket said "You are not a winner" on a winning ticket. Let the lady have the ticket and sue the people who made the machine!

G-d forbid instead of dragging this in court and paying lawyers, they would just agree to split the money somehow. If not, I think the woman who found the ticket should get. And yeah, let's take "no digging through garbage" sign REALLY seriously - bc that's NOT what millions of people do on a daily basis Lena

Lena, unfortunately the judge disagreed with you and the woman has to give the money to the other claimant. Problem? The "trash" winner has already spend part of the winnings and will appeal. The only winners in this game will be the lawyers who will end up taking every thing taxes haven't.
O, and according to a store employee the sign that you could not dig through the trash went up after the winning ticket had been removed from there...
