From the link in the OP. workrights.us/The National Workrights Institute was founded in January 2000 by the former staff of the American Civil Liberties Union’s National Taskforce on Civil Liberties in the Workplace. The Institute’s creation grew from the belief that the workplace is a critical front in the fight for human rights and the belief that this effort required the creation of a new organization dedicated to human rights in the workplace. The Institute’s mission is to be the one human rights organization which commits its entire effort to workplace issues. The Institute’s goal is to improve the legal protection of human rights in the workplace. We believe that the core problem is not that workplace rights laws are inadequately enforced, but that these laws, even on paper, are grossly inadequate. The Institute’s strategy is to select a small number of issues where there is both the potential of creating substantial long range improvement in workplace human rights and a current opportunity for constructive engagement. (This is political..) Yes, ugonow-- chipping away at individual rights, one smoke and dorito at a time...... this me of enacting cap and trade through the EPA rather than new laws that would NEVER pass a vote. Or constantly trying to get rid of talk radio through sneaky, back door methods... Fun thing is the new healthcare law, which I don't think will stand in the SCOTUS, won't allow people to be turned down for insurance, so then what will they do?? Really and truly try not hiring fat people, or people with a genetic disposition for cancer, diabetes, etc?? LOL!!! Gestapos!

Krickett:
It's so odd that some people will think not hiring based on predisposition for health damage due to smoking is good, but would have major problems with not hiring based on predisposition for health damage due to AIDS. Or breast cancer.
Smokers and even ex smokers have become perfectly acceptable people to discriminate against these days.
Hypocrisy seems to have become acceptable.

So true, verrip... How about drug addicts and alcoholics that won't stop their suicidal behaviors getting SSDI?? True, I know 2 of them from 12 step meetings. Mental illness.. qualifies them as SMI (seriously mentally ill), which qualifies them for SSDI for life. Those poor crackheads.. .... but you working cigarette smokers-- leave our building, leave our city, DIE!!!!!!!!!!!!!!!!!!!!!! Such drama over cigs..... And you know businesses can get subsidies for hiring ex cons and drug addicts?? Yup, yup, but-- smokers that work should LEAVEEEEEEEEEEEEEE, so someone less fortunate that does not smoke cigs and is worth a subsidy from the gubmint can step in....

As a former, not current smoker, the new rules and regulations don't really affect me. Except that... Leave the smokers alone. It's legal. Let them smoke at home, in their cars and in public parks. As long as they aren't smoking in the workplace, what's it to you? So it bothers you? Well, perfume bothers me, I don't think you shouldn't be able to wear it. People are bothered by car exhaust, cat hair and ragweed. Do we prohibit them in public places as well? In private? It is risky behavior. So is mountain climbing, skateboarding and bungy jumping. Bar hopping. Walking alone at night. Should they all be legislated out of existence? Enough, people. Stop trying to legislate every aspect of life. I don't want myself or my kids to live in a bubble. Life is a crapshoot, embrace it.

Gosh, Malarky-- I like you. Do you ever go to politics?? It can be a nasty place, but you think with reason-- we could use some there. This thread should be there, but.. you know... If I ever get through going crazy in politics I want to stop in here to heal. You people seem very nice.

People who say they can't quit don't want to quit smoking. It's become a component of their functionality. That, by the way... is crap. Working smokers are nasty people. Bad attitudes that take twice as many breaks to contribute 2/3 the productivity non-smokers do.
My pet peeve assinine smoker move is to puff away just outside a doorway, take one last big drag, litter it still lit, then turn and exhale INSIDE the building.

picking on smokers or the obese is much easier than picking on people who are into extreme sports or most people with hereditary or contracted diseases because their risky behavior is more readily apparent.
i can't remember the last time i was sick enough to go to a doctor and the last time i went to the hospital was about 13 years ago but if i ever have to see a doctor or go to a hospital i do not want to be treated by anyone reeking of cigarette smoke or some who is obese. if people can't take care of their own health why would i want them to take care of mine?

A major hospital here tried to set up a "we won't hire smokers" policy a few years ago. They were told in no uncertain terms by the Labor Board it was illegal and they would be wide open to lawsuits. They quickly dropped the plan.
