It's LEGAL to mutilate a woman's bits, so that she can never enjoy sex? Law banning female genital mutilation ruled unconstitutional; Michigan doctors cleared of charges A federal judge on Tuesday ruled that the U.S. law banning female genital mutilation was unconstitutional and dismissed charges against several doctors in Michigan who carried out the procedure on underage girls as part Muslim sect’s religious practice. U.S. District Judge Bernard Friedman ruled that Congress had no authority to enact a law that criminalizes female genital mutilation (FGM). “As despicable as [FGM] may be… [Congress] overstepped its bounds” by banning the procedure, the judge said. www.msn.com/en-us/news/us/law-banning-female-genital-mutilation-ruled-unconstitutional-michigan-doctors-cleared-of-charges/ar-BBPWRsv?li=BBnbcA1

It is one of those tricky things with our system. The Federal Government has limited power. They overstepped it in this area.

They should appeal based as a type of sexual abuse of minors.
Horrific this kind of abuse can occur in our country and be legal.

I'm not sure I recognize our country right now. Anything can be done, as long as it's done to a woman, and not a man. Disgusting!

I'm sorry....What?!? It's child abuse. Plain and simple. I don't care if the parents are okay with it. Lots of parents are okay with beating and raping their children. It doesn't make it okay or legal. This makes no sense.
From the link:
“There is nothing commercial or economic about FGM,” Friedman wrote in the opinion. “[FGM] is not part of a larger market and it has no demonstrated effect on interstate commerce. The Commerce Clause does not permit Congress to regulate a crime of this nature.”
Shannon Smith, Nagarwala’s lawyer, told the Free Press that they are “unbelievably happy” after the judge’s ruling, saying “The impact is huge. It eliminates four defendants from the indictment, and it severely punctures major holes in the government’s case.”

There are plenty of Christian based cults that do horrific things to women and children as well.

First, I think it is completely abhorrent that any “religion” or “culture” thinks this is acceptable to do to anyone. That said, lawmakers are human beings who are subject to emotion and the desire to be re-elected. So they allow (and encourage) public sentiment to create a situation where bad laws are passed. By “bad laws” I do not mean laws that do not intend good things, but laws that are poorly written or structurally unsound. The court is not saying that the purpose of the law is bad, they are saying the methodology used to create the law is flawed. It’s a technicality, but it’s important.
I’m trying to think of an example that is not as emotionally charged as this situation is and having trouble. In all likelihood a new law will be passed that has the same results as the unconstitutional law, but without the technical flaws. I hope that the prosecutor will turn around and charge them with child abuse at the very least. It’s kind of similar to Al Capone. All the stuff he was responsible for, and he went to jail for tax fraud. But the point is he was in jail. Stop these people by using the laws that already exist.

I remember my grandmother and my mom saying, "What's this world coming to?!" After reading about this, I thought the very same thing.
I've turned into my mother!

It's a great pity the right of free speech isn't based on the obligation to say something sensible.

"Female genital mutilation (FGM) is a practice involving the removal of all or parts of the female external genitalia. It has been documented in 28 African countries and in some countries in Asia and the Middle East, but due to increasing immigration from these countries to the western world, FGM has become a worldwide human rights and health issue. Contrary to the belief that it is a practice carried out by Muslims only, it is also practiced by Christians and a minority group of Ethiopian Jews. However, FGM is neither mentioned in the Torah, nor in the Gospels, and – like in Islam – bodily mutilation is condemned by both religions. In fact, FGM is a mix of mainly cultural and social factors which may put tremendous pressure on the members of the society in question." www.sciencedirect.com/science/article/pii/S1110570413000258Posted for the record.

I hate this! I was happy to see them charged and now they get away with it. While the group may have gotten off on some charges, there are still other charges filed against them. Additionally, the U.S attorney's office is still considering whether to appeal the judge's ruling. From the article in the OP (and yes I know those remaining charges don't address the FGM, but take a win when you can get one): "While the charges of performing FGM were dropped, Nagarwala and other conspirators are still facing conspiracy and obstruction charges, according to the Detroit Free Press."

Currently, there is anti-FGM legislation in only 27 states, meaning that 23 STATES HAVE YET TO CRIMINALIZE FGM. link

Lorena Bobbitt needs to get her name cleared. Removing genitalia without consent is not illegal after all! See how that works? You put your dingeling where it does not belong and your woman cuts it off (or maybe you just ticked her off). Can't have a law against that. Life may just have become really scary for men who stood in church and swore to forego all others, especially if they then forget that little oath.
