I have more questions about what happened because as presented it makes no sense that he would be found guilty. Did he somehow force her to perform oral sex? Is that the only sexual contact they had? If there is nothing more to the story this is wrong. Following the rules in bold, he is guilty of breaking the rules as stated. It doesn't matter if he was intoxicated to the point of being barely functional. Despite an accuser who offered borderline non-coherent responses that subtly expanded on her initial story, the panel ultimately accepted her credibility. It ruled that while Doe likely was “blacked out” during the oral sex, “eing intoxicated or impaired by drugs or alcohol is never an excuse.” Since AS [the female] said she withdrew consent at some point during the sexual act, and since Doe couldn’t challenge that recollection, the panel was at least 50.01 percent inclined to believe the accuser’s tale.

As someone else pointed out, blackout does not mean he was barely functional, it means he can't remember what happened. Does "withdrew consent" mean he forced her to finish? If he forced her I agree that intoxication is not an excuse.

How do you get someone passed out to even respond to anything, let alone oral sex? How could "it" even get hard? Who said that they were passed out? They said blacked out. Here's an example. I went for a colonoscopy and woke up, dressed, spoke to the doctor, instructed TD to get my car and how to bring it to the medical center. I then directed him downtown to a parking garage. We walked into the arena to buy tickets for an event, and the first thing I can remember is standing in front of the ticket office. I remember NOTHING from the time I went in for my colonoscopy and the drug hit my system, and yet for better than 50% of that time, the only reason why I know what happened was that TD told me. During this time, he said that I appeared to be totally normal and functioning. Fortunately, TD was in the room when the doctor gave the results because I have absolutely no idea what she said, despite the fact that he said I asked her several questions! To this day, I still do not remember that time.

If he forced her I agree that intoxication is not an excuse. Withdrew consent could mean various things including saying she no longer wants to do this, but keeps on going. Something else from the article seems to go against it being force and more likely regret.

fatbear that's why I said if he forced her. I would really be interested in the full story here.

So, he was assaulted, and he was expelled. I guess next time a guy has sex with a drunk and passed out woman, he can complain that he was raped? Or does this only work in favor of women?

This is actually a great example of why people need to SHUT THE FUCK UP. It doesn't matter if you're innocent, it doesn't matter if you have nothing to hide. SAY NOTHING.

And btw- there is going to be a backlash at some point for all the fucked up shit going on in our culture. I suspect it is going to be rather sudden, and unforgiving, and not like we're not going to ease back into normalcy- where rape is rape; and buyer's remorse is buyer's remorse. Where you actually go to jail and pay tremendous civil penalties for libel, and slander. I predict the backlash is coming sooner than later. This society is a powder keg right now- 1% to 3% complete and total corrupt whack jobs have their boot on the neck of the rest of us, and at some point we're going to simply stand up, push them out of the way, go on about our business and the whackdoodles are going to be ignored for 2 or 3 generations before they even begin to make a comeback.

So in summary, democrats, liberals and progressives will be runing the country for the next 2 or 3 generations.

So in summary, democrats, liberals and progressives will be runing the country for the next 2 or 3 generations. That would be ruining the country.

The current generation always thinks the subsequent generations are going straight to hell. During the flapper age, some communities had laws that sent women to prison if their skirts were more than 3 inches over the ankles. Utopian communities back in President Garfield times advocated for free love, with woman sleeping with any man she wanted, much to the horror of stiff New England puritans. The lurid jazz music and frenetic dance crazes during Prohibition would lead to orgies, and the music people like Elvis borrowed from the blacks in the 50's would cause blacks and whites to sleep together. Then there were the lascivious, long haired Beatles with their pounding rock music inspiring girls to think about sex. We always move forward. Society never does collapse, although there have been periods of sustained turmoil. What you perceive to be a 1 to 3% group of whackadoodles corrupting society, which is on the verge of overturning them, is not actually reality, but wishful thinking.

I don't think subsequent generations are going to go to hell. That is precisely my point. I don't think the Boomers are going to succeed in dragging us down into the sewer. That's my point- a backlash is coming.
