When a transaction takes place between private (unlicensed) persons who reside in the same State, the Gun Control Act (GCA) does not require any record keeping. A private person may sell a firearm to another private individual in his or her State of residence and, similarly, a private individual may buy a firearm from another private person who resides in the same State. It is not necessary under Federal law for a Federal firearms licensee (FFL) to assist in the sale or transfer when the buyer and seller are “same-State” residents. Of course, the transferor/seller may not knowingly transfer a firearm to someone who falls within any of the categories of prohibited persons contained in the GCA. See 18 U.S.C. §§ 922(g) and (n). However, as stated above, there are no GCA-required records to be completed by either party to the transfer.

I am not trying to place Ed1066 in the woods. - I just wanted to point out that uncontrolled flow of weapons may not be a good thing. - That background check are easily averted through fake ID's and that despite registration requirements.... there is a thriving black market and above market economy where guns are finding themselves in the wrong hands.

That's OK I'll toss Ed in the woods- I can legally sell a gun in a gun show parking lot if I want to. Money for gun- end of transaction- easy as pie. It is not anti-gun propaganda as he claims-it is a fact.

The SF gun bans are just a stupid symbolic gesture. Previous ones have already been ruled unconstitutional.

Ed was saying it was federal law- it isn't- states on the other hand may vary. I live in a gun friendly state so I can CC most places- or open carry, or I can ride around with a loaded shotgun or rifle too- wouldn't try that in NYC.

Evt1: More and more legal gun shows are now putting security personnel in the parking lots and putting signs that say no private sales on premises. The gun show promoters pay for the lease for the show and they are trying to stop the black market sale of guns plus if you want to buy a gun they say go buy one from a dealer who rented a booth. Some of the security at these shows are actually BATF looking for people black marketing class 3 firearms.

Now that's a good idea. I imagine there are undercover BATF looking to buy too.
What I don't agree with is that this was an 'Obama' anti-gun owner policy. I don't think he is really that concerned with gun owners- I think the NRA is running out of stuff to complain about really- in my state they are holding yet more meetings to increase gun rights, and we have plenty, everything except in bars and that's coming. What else do they want? At least in my state they can shut up already and go somewhere else that has a gun control problem.

Evt1: I am afraid you and bubbly are confusing yourselves. If I want to sell a fire arm to my neighbor without a background check it is true I can. But as far as selling at a legal gun show all dealers represented there must have a federal fire arms license to participate. There is a form you fill out and the dealer if you notice will have a phone sitting on the table and they will make a call that will confirm that you can legally buy that firearm. There is a data base that has a list of names with SS numbers and if you are on that list no sale. That is basically how the federal rules work. Any licensed retailer of firearms must do a background check. If they do not and caught they will lose their license and pay a hefty fine. Examples, I live in NC a dealer in Georgia cannot sell me a hand gun and let me carry it out of the premises. They must send the gun to a licensed gun dealer in NC who will for a fee do the background check and if I am clean deliver me the weapon. In the case of cross state sales not all states have this rule. And if you want to CC on your person most sates that allow this you must go to a class and get a permit. Open carry laws are all over the place.

No confusion here- I know what the dealer rules are- I also know what people do.
As far as CC my state only issues a carry permit- it does not specify open or concealed- and requires a class/background check/etc. I only carry concealed- I think open carry is stupid.

I agree that open carry unless you are out hog hunting with a side arm is mostly an ego trip. Even though I am a NRA member I also have concerns about some being allowed to conceal carry. To many do not really have the training to pull a weapon in public and hit what they are aiming at. Most CC classes are really a joke when determining if a person can safely fire a gun in public. Even police who fire thousands of rounds only have a 45% hit rate of a perp. I have a CC but I only do so when I am carrying a large amount of cash.
