(Lurkyloo) I'm curious about the disturbing native birds nests; does that still apply if, say, they build a nest in your attic? Would it have been more legal to shoot the parents for being nuisances and leave the babies to fend for themselves?Migratory bird act en.wikipedia.org/wiki/Migratory_Bird_Treaty_Act_of_1918"The statute makes it unlawful to pursue, hunt, take, capture, kill or sell birds listed therein ("migratory birds"). The statute does not discriminate between live or dead birds and also grants full protection to any bird parts including feathers, eggs and nests. Over 800 species are currently on the list." "Migratory birds may seek respite within trees or on buildings considered private property. The Migratory Bird Treaty Act of 1918 prohibits the removal of all listed species or their parts (feathers, eggs, nests, etc.) from such property. However, in extreme circumstances, a federal permit might be obtained for the relocation of listed species" So you're basically screwed if you adhere to the letter of the law. And all Scrub Jays, not just the Florida sub-species, are on the list. I would doubt that this gets enforced on the homeowner level.

Blue Jays are lovely birds. Unless you harass their young. Then they get mean. A pair of blue jays built a nest in a tree out back a couple of weeks ago. A couple of crows tried encroaching on that area about a week later. My, those jays didn't like that! They chased the crows away.

True, but not all true. At my birdfeeder, they will attack the other birds and take over. They are beautiful to watch just as Cardinals are, but they will attack the Cardinals as well. ![](http://autumnearthsong.files.wordpress.com/2010/11/386-blue_jay.jpg)

Ugh. That's a LOT of netting if I have to cover every area in my yard! Hm, so I could technically have put netting over the tree in question after the fact, trapping the baby birds inside and the parents outside? I have no quarrel with blue jays, largely because we don't have them out here. I do seem to recall reading that they were fairly aggressive among other birds. If you tell me that scrub jays are lovely birds, though, I'm going to have to conclude that you've never met one. ![:P](//storage.proboards.com/forum/images/smiley/tongue.png) As to local/homeowner-level enforcement...I'm pretty sure the local law enforcement would be cheering me on! Probably a good thing this is an anonymous message board, just in case.
