New York law makes it tough to remove Benjamin from the June primary ballot: He could move out of New York to disqualify himself from running for state office, or the state Democratic party could let him run for a down ballot office.
Why is this a law? It's the same thing that kept Collins on the ballot after he'd been arrested for insider trading. And, of course, Republicans voted for him because of party. Then he spent all his time in office on his defense instead of representing us, until he was finally convicted and resigned, too late to have an election to fill his empty seat.
