TheHaitian - Pay your deductible for now. Your insurance company will recoup it. It may take a little bit of time, but trust me, it will take them less time than it will take you. Again, they have entire legal departments built for exactly these cases. And now you know, you're not going after the kid/driver. You're going after his parents (and their insurance). It is much more likely that if you do have to file a civil suit that you will be able to get the $500 back from the parents than from the kid. This is an important point if you end up going to small claims court to get your deductible back. Our daughter was on her way to Florida with her friends when she was involved in a fender bender in a McDonald's parking lot. She said it wasn't her fault, and the two insurance companies decided to each take care of their own. The other party sued our daughter in small claims court for her deductible. The case got thrown out because she should have sued my ex as owner of the car. The woman didn't refile.

I just call my insurance and let them handle claims, that's what you pay them for.
Go to doc, they always give you forms asking if this was an accident or not, so if anything is wrong they will go after them.
I wouldn't waste my time on it. And you may or may not get your deductible back, but it could take awhile.

File claim. Pay deductible. Move on. Life's too short to deal with this kind of stuff any longer than you have to- your time's more valuable that your insurance deductible. And if it's not- go work on that.

Hey everyone ... short update:
Finally dropped off my car at the body shop today and got the rental car.
Called the insurance company. As we stand:
- it does not seem they have insurance coverage - the adjuster wrote them and giving them a week to follow up on information about insurance (they don’t have any) and I guess in MD they have to go after the driver not the owner of the vehicle so they want the name of the driver at the time of the accident.
How does that affect me: - now I am under the collusion part of my insurance and they also open a medical claim with a separate adjuster. - this medical coverage only covers (in DC) what my regular coverage would not cover.
But since now they do not have insurance I will be move to uninsured motorist with it’s own adjuster - they will act as if they were an adjuster for the opposite team - review everything and offer a settlement (medical, etc). - then they would go after the other person / driver for whatever it costs them.
Basically nothing I can do. I decided to wait till after I am offered a settlement or whatever to decide my next move.

Just so people know- this is standard insurance industry practice. There's no double coverage or "betterment" from insurance. The first question almost any insurer will ask after whether or not this is a covered loss is whether the insured is covered elsewhere for the same loss?But since now they do not have insurance I will be move to uninsured motorist with it’s own adjuster - they will act as if they were an adjuster for the opposite team - review everything and offer a settlement (medical, etc). - then they would go after the other person / driver for whatever it costs them. Carl, don't get mad, but sometimes you make some funny typos. Collusion would mean that you and the person who hit you were scamming the insurance company. You meant collision. It's been a few years but I was covered by both my insurance and the other driver's when he rear-ended me in D.C. This is one of the only areas where "double dipping" is fine for medical expenses. I was injured, though not seriously. His insurance covered the costs of damage to the car, and the rental car expense. My injuries could only be adjudicated after a few months because of physical therapy - it took that long to complete. The medical included costs such as for a house cleaner, since I was unable to do my usual chores for a while.

Should I hire a lawyer?
Everyone reaction (dr/people etc) when they find out I was in a accident is to ask me if I hired a lawyer.
I even had the law firm that called me saying if they were calling me is because I was in a recent accident and it was not my fault.
Do I need one?
1) suing the other driver? But what would I get out of it? I am assuming they did not go without insurance because they had too much money, it is a 2017 Toyota Camry (rather new)... so either they were foolish or broke? Will suing them get me any $$$?
2) to negotiate with my company the settlement amount? Will it make enough of a difference to justify the cost?

I would base my answer to this based on how hurt you are. If you're worried about a major injury, then yes, a lawyer might be prudent. If you're talking about some soreness and minor inconvenience, then you're talking small claims money and I wouldn't waste my money paying a lawyer.

If they don't have insurance, suing them will likely get you nothing. Any personal injury lawyer will take 30-33% of the settlement for their fees and possibly expenses on top of that. Any settlement would also have to reimburse your medical insurance for the cost they've paid. So unless the injury is serious enough to have some major ongoing care you'd likely see very little in your pocket after a lawyer. Though I'm not thinking you'd get a whole lot above what you have to repay your medical insurance and any copays/deductibles spent unless it's impacting your life beyond just feeling pain.
As for doctors and everyone else - it's a standard question regarding accidents. They want to make sure they're in line for any payment you get and if they need to send the records to anyone.

He said earlier that the "kid" wasn't authorized to be driving the car, "his license did not authorize him or permit him to be driving at that time (maybe why he flee) because the cops would have arrested him once they got there." Not sure how that affects things, but would think a driver should have a valid license.

I know that my brother had enough tickets and accidents that my parent’s insurance company told them flat out if he were driving one of their cars, to consider themselves uninsured. He had his own car, and his own policy and was not allowed to drive my parent’s cars.

When we were rear-ended while stopped at a red light several years ago, the car was insured but the driver wasn't an authorized driver on the car owner's policy. Ultimately the car owner's policy paid because the owner's only recourse would have been to claim that the car was taken without his permission or knowledge which meant the driver would be charged with vehicle theft. The driver was the owner's daughter. I doubt if he was renewed because I had to replace the rear bumper and they paid medical expenses for my rear-seat passenger which amounted to a lot of $$. The driver probably would have left the scene but it was rush hour and the local university campus police were right behind her and blocked her in. They also heard me begging her to take care of her hysterical minor children in the vehicle which she refused to do.

The other driver's insurance company in the end settled for paying another $10,000 to me without a lawyer. I asked for $12k. I was pleased; I thought it was fair. I was not seriously injured but did need 3 months of PT for my neck and back.

I looked up DC provisional licences and it's the same as ours, infractions like driving off hours or having too many underage kids in the vehicle just results in points on your provisional license and you have to accumulate quite a few before anything happens. Of course, being a teenager and not having any experience he probably panicked.

Yea but remember Carl smelled other stuff on him so he may not jave been sober too.
My insurance covers a license driver in my car. Don't know how that would play out if the license wasn't valid at that time. With my hit and run the driver was not on the cars registration and the drivers address was differnt the the owners. All of that info was on the police report. Including both vehicles vin numbers, diagrams of what happen, who was at fault, and more information. The owners insurance covered everything, including a rental for us until we got a new car. I had to call once to extend the rental.

From that day on I never let anyone behind the wheel of my car and that was 37 yrs ago. Some lessons just stick with you forever.
