This seems so obvious, that since he has been in DC for over a year there is no way he should be eligible to be Mayor of Chicago, but I know this happens all the time, people can 'set up' residences to get past most residence requirements, Rahm must have not thought about running for the Chicago mayor until it was too late to get it set up correctly.

He owned a home within the residency limits, but had it leased out while he was in DC. That's where the rub is, he didn't actually live there.

Setting aside the individual situation of Emanuel and Chicago:
I think that serving as an advisor to the POTUS should be considered in the same light as serving the nation in the military. I did not stop being a resident of my home city and state when I was stationed on the other side of the world.

He probably could have got by if he actually hadn't leased it out (received money) and also likely someone took extra effort to uncover all the details of the residency.

Ah, I'm not really even sure what the residency requirements for Senator are, and this isn't in any way just a Democrat thing, she was just the most famous politician I could think of who seemed to serve somewhere not related to where she lived. I am a firm believer that an absolute minimal number of bureaucratic requirements be placed ahead of the people's right to select the person they wish to have represent them. This is also how I feel, which is why I have mixed feelings about term limits.

Each and every Representative and Senator is limited to the number of terms that the voters they represent give them.

The great fixer, Rahm Emanuel, couldn't even figure out if he wasn't legally allowed to run. I guess there are still some things he can't fix. After coming from a corrupt federal administration, he figured he could thrust himself into an illegal candidacy! Well, we all know the arrogance of power of the Administration he just left. He just could not believe that he would be forced to follow the rules.
Pretty indicative of the Administration he once directed. I'm sure Obama today just wishes he would disappear off the face of the Earth.

Gabby Giffords lives in Houston-- before the shooting, of course, with her husband. We did not like that here in AZ-- JUST short of the majority of us, but she met residency requirements. No, she did not rent her house out, and stayed in it often. Smart people know the rules and laws. Rahm is an idiot. I just hope his ex (Obama) does not take him back. We do NOT need that little twerp running around naked threatening people again.

Court tosses Emanuel off Chicago mayoral ballot
Not to worry Emanuel has his buddies Obama and Eric Holder working behind the scenes to get this Appeals Court ruling overturned so stay tuned.....Emanuel's name will be on the Chicago Ballot because Obama needs him for his re election campaign in 2012 to deliver the Chicago voters for him..
