To sue Sarah Palin, the victims would need a valid legal theory under which a civil lawsuit could be brought. While I am unaware of the ins and outs of Arizona tort law, I can opine that I'm skeptical that there is one under which a SUCCESSFUL lawsuit could be brought. On the other hand, the victims could certainly sue the person who shot them.... though I doubt that would be financially worthwhile.

Palin and Angle Didn't Use Political Rhetoric, They Gave Jared Loughner InstructionsIncitement to violence? Conspiracy to commit murder? Soliciting a criminal act against a specific individual? Willful disregard? All of these, and perhaps others, are questions that warrant, at least, an investigation. Both Palin, and Angle, have garnered a great deal of press for their violent rhetoric. Both have been warned that their public calls for “second amendment remedies”, and to “don’t retreat, reload” – accompanied by maps with gun-sites directly identifying Congresswoman Giffords, among others – could lead to acts of violence. They were made aware of the potential dangers, and yet they chose to continue on their course. Immediately following the incident, Sarah Palin scrubbed her websites of all such material. This can easily be interpreted as a profession of guilt. Too little, too late, but a sign that, perhaps finally, she realized her culpability for Jared Lee Loughner’s actions. After all, he did pursue Sharron Angles “second amendment remedies” against an elected politician of the opposing party identified with gun-sites on a map distributed publicly by Sarah Palin. This goes beyond just rhetoric. This is a direct prescription for an act of gun violence by Sharron Angle against a public figure identified as a gun target by Sarah Palin. This is not simply rhetoric. These are clear instructions of what to do, and against whom to do it. This warrants a criminal investigation against these two individuals and should potentially be expanded to include other politicians, and pundits, that aided and abetted them in this scheme. The current conservative, Tea Party, congress is unlikely to initiate any such action. State and local police are unlikely to get any support, and likely to receive a great deal of opposition, to any investigation that proceeds down this road. If there is going to be a real investigation, it can only come through the action and support of communities and individuals dedicated to ending the violent threats, and calls to arms, relentlessly repeated by far right politicians and their media counterparts. Perhaps Attorney General Holder will consider this miscarriage of free speech rights, by these two individuals, that has resulted in the loss of life of American officials, rather than pursuing Julian Assange and WikiLeaks that has only resulted in the establishments embarrassment. WikiLeaks has made no such prescriptions to violence, or resulted in any deaths. Sharron Angle and Sarah Palin have obviously crossed the line of ‘yelling fire in a crowded theater.’ If anyone should be investigated, and charged, it should be these individuals, and their supporters, and not those who have simply exposed the American governments dirty laundry. These two people have acted in a way that can arguably be attributed to the cause of the deaths of six individuals, including a federal judge and a young child, as the actions they prescribed – the second amendment remedy against a particularly targeted individual – were being carried out. We must call for an official investigation, subpoenaing of the posts that Palin has scrubbed from her sites, and any other relevant material from all connected parties, and exercise the power of the American judicial system. Congresswoman Giffords publicly stated her concerns about Palin's target map, but Palin did nothing about it:
We need to realize that the rhetoric, and the firing people up and … for example, we’re on Sarah Palin’s ‘targeted’ list, but the thing is, the way she has it depicted, we’re in the crosshairs of a gun sight over our district. What really saddens me is to see so many sheep in lockstep with the radical progressive nut-jobs promoting these silly ideas. beaaaaaaahhhhhhh. It's pretty sad state of affairs when a guy that shoots a congresswoman point blank is the "victim" and people search for somebody else to blame besides the shooter. Pathetic...really.

BTW Diverdown34 warned you all this would happen with Lakhota spreading so much of this stuff all over this board and he was right.

My sentiments exactly. People like Lakhota and several others on this board are just as responsible as anyone for constantly blaming, bashing or otherwise stirring the pot that creates much of the angry environment instead of engaging in meaningful discussion that could result in bringing some civility to conversations and resolving contention between individuals or groups. What he apparently doesn't realize is that it is this type of rhetoric from him and his party that cost them the election in 2010. On the other hand maybe it is helpful to have people see in a public forum such as this message board exactly how these people operate.

If it's a short post, it's usually a bolded headline and a link. Besides the occasional one liner, very rarely are there any original, personal thoughts. I like to make up my own mind and don't need to rely on any slanted, biased liberal or conservative websites to tell me what my opinion should be. Lak has a right to post just like I have the right to skip over them so I say let it be. IMHO, lak's agenda, whatever that may be, does more damage to the reputation of the progressives than palin's does to the conservatives. But, at least palin isn't afraid to speak what's on her mind...even if it does make her sound rather unintelligent/uninformed/whatever about politics.

I agree with Florida Yankee. If you just ignor Lak's posts then maybe he will get the message. Just for the record I had a friend who ran for office in a particular race who was know as basicly anti-gay in phylosophy and the gay coalition passed out flyers with his picture and a crosshair over his face. It did not induce anyone to shoot him. Matter of fact it seemed to help him.

On the other board he said he has his team on the problem. If he would just join the team, then he wouldn't have time to be here on the board.

There have been several people posting the same type of liberal fantasy and most have been permanently banned. I wonder if it's all the same person, just different names and identity.

Who were they...as long as the "middle to the left" is allowed o post , I guess I will feel safe , but to be honest..unless I have been missing things..and I do just post mostly here, occasionally going to EE and a few other boards, but they seem a bunch of laid back folks so doubt a lot of banning there, here, political, the moderators have been very kind so to speak, besides a warning from time to time and possible a delete, very , very few time outs and only one ban that i know of, though possible i might have missed another ..so who has been banned?

We have seen the growth of an entertainment industry which is based on political theater. Cable news, print, and web, radio. This is fed by hundreds (thousands?) of professional propagandists and spin masters. And there are millions of True Believers who are so emotionally invested in their "team" that they are unable to discern fact from fantasy. There are a number of posters here whose writings provoke thought and reflection. There are many whose writings do not. I try not to spend my time on the latter.

I think over long articles are to much.
I sometimes still so post but as some one here had pointed out, and i have tried to do it...I try to copy the pertinent thoughts of the article , with a bit of my own feelings or questions of and then the link...
The ones I just skip completely by are the yoo tubes/videos..first thing is usually the video is a start/stop with my computer, have no idea of why and being now of the new age , no patience..I prefer reading...just a personal thing but I wonder while subject came up by me..any one else feel the same way about the youtoo video's or any other videos for that matter.
I don't run away from article because of who is the one there coming from..I might check out the source to get a idea of where it's emulating from..so to get a feel of veracity, unless so off the wall that just a turn off..well discussed idea from the other side, thats good when it happens.

Of course she can be sued over this. Anyone can be sued by anyone else for anything. This is so very true. I once defended a homeowner who was sued because a neighbor child ran into a garbage dumpster with his bicycle, and was injured. (Note: located at the curb, where garbage dumpsters go, but it wasn't his dumpster ~ the city dropped it off there by mistake. Of course the city was also sued.)The poor homeowner was flabbergasted that he could be sued for a "stupid kid" riding his "stupid bike" into the side of a "stupid trash dumpster" that wasn't even his, merely because it was parked in front of his house on a public street. Fortunately, his homeowners insurance paid for my fees/costs ... and they eventually just dropped the case because the insurance company had no desire to pay to settle such a case (which would just have encouraged the plaintiff's attorney to file more stupid lawsuits.) That was one of three stupid trash dumpster cases I once defended.

Just curious Molly....if the case had gone on, and the defendant had won, could they then get legal costs back from the one who initiated the case...possible even damages? The problem of these suites any one can bring them and i am sure the plaintiffs attorney didn't take the case pro bono or on a contingency basis..I am sure he would have thought this was a tough one to collect on. Just curious how that plays out. Attorneys in my area seem to start at $250 per hour and up and up.

Deziloo ... if the case had gone to trial, neither defendant had legal grounds to recover fees, but they could file a motion to recover costs (subpoena fees, jury fees, costs of obtaining records and transcripts.) Why? Because the plaintiff sued under a theory of negligence, and in California, attorneys fees aren't recoverable for such lawsuits.
Generally speaking, you can only recover attorneys fees unless they are permitted (a) by contract or (b) by statute. Many employment discrimination statutes, for example, contain attorney's fees provisions.
