crisde2bdebtfree - Thank you for the lovely poem and kind words. My dogs are a huge part of my life and now there is a big piece of it missing. My other dog is starting to adjust to being an only dog. I'm now working on saving extra money every week to put toward an adoption fee for a new buddy for him when we are ready.

I had knee surgary this Friday so that is slowing me down a bit. Kinda nice to be having a break from work but at the same time I am frustrated by having to be lying on my back with my leg up in the air for three days. So am taking the time to finish up a quilt and read a lot of books I just did not have the time for.

Howdy... OK. I don't have any kind of problem with my mortgage. What I have is a filing by an attorney for a bank called First NA Bank who bought my balance from BofA. In 2008, when all this began, BofA was unregulated (as too many creditors were), and they raised my interest rate from... 11.9, as I recall, to 22.9 over the course of about 6 months, doubling my minimum payment, making it impossible for me to pay after I was no longer working, and they began this NOT because I was late when they started the little game, but BECAUSE they were not regulated. Of course, the games CC banks were playing with a lot of people were stopped after awhile, but it took some nasty arguments in DC. Things I know (and/or have learned the last couple of days): - BofA could not *sue* me for a return of my overdue debt because they hold my mortgage: it would be a conflict of interest
- BofA sold (as banks do) a bundle of debts, this is always a combination of good and bad which financial institutions will put up for auction, they have to include good debts, this is how mortgages get sold, so if you've been through a couple of mortgage lenders over the years, this is why
- What they sold to this First NA bank is actually about $33G with late fees and higher interest, etc. (ah, yes, let's raise my balance... *sigh*)
- Anyone who buys up unsecured debt actually buys it at a flat amount. So when THEY come knocking (in form of a lawsuit), they push for the whole amount, they will not be filing with an interest compounding account, they are not giving or allowing credit, so effectively, whatever gets brought up in court is one lump sum
- This is not a lien. It is a THREAT, the lawfirm representing this First NA bank has just filed with the city of Philadelphia. They did this back in February, btw. And according to this filing, I have 20 days to respond. Conveniently, I didn't actually receive it for more than 20 days, so I'm already batting zero, here, so far as the motion is concerned
BUT - It's only a motion filed. It was actually NOT delivered to me by the sheriff, as all these lovely little letters I received from all these law firms trying to get me to call them tried to claim, it was delivered - without a receipt or a signature, by the way, or even a request of proof that as I stood in my front yard that I was even ME (which is what actually occurred) - by a private courier, NOT any official. All of them also said I was being evicted, there was a lien, I should file bankruptcy, etc. Calling BofA, they basically said it was ridiculous, they would know if there was a lien. After I spoke with a couple of friends with money, I asked a couple of questions of my accountant who told me it's NOT actually anything to worry about YET, and she suggested I start looking for the money in my budget in case it ever goes to court. I also called my attorney. He told me to not yet do anything, not until and unless anything comes from the actual court, because this is NOT actually anything signed by a judge. YES, it's possible they'll succeed in getting a judge to hear them out. But it's also possible this may not go anywhere, partly because they are NOT actually the original creditor, which can work against them. And he also told me to start looking for money in my budget. Now, he also told me even if they do get this legally sanctioned and it attaches to my mortgage, well, it's a lien, NOT a ruling that I have to pay it, they cannot demand I sell or even force me to sell, and if and or when I sell my house, it can be fought, and - if I never move, well, it can just sit there, gathering dust, never increasing, and if my home is sold after I die, only then would it be payable. I can also appeal the lien after the fact. So if I choose to ignore this law firm, and everything goes through, I can also request of a judge that it be reduced or eradicated. But... in the meantime... my neck is stiff... *sigh*

Just got some wonderful news about the balance transfer I was told I was getting ... And by wonderful I mean terrible and I could cry ... They had told me last weekend that the transfer should go through Monday or Tuesday and to keep checking my account. Well as of today still nothing so I called the new credit card company to find out what is happening. They told me the transfer was rejected. They told me it could either be on there end or on Target's end because they are not willing to give up my debt. The man I spoke to talked to his manager and his manager plans on investigating this for me but in the mean time they resubmitted the transfer and told me to call them on Tuesday to find out what is going on. If its a problem with them well then there is nothing I can do and all I have is a 0% interest card for the next 12 months that I wouldnt do anything with but if it is on Target's side they said I can transfer over other debts which is what I would probably do. Am I doomed to have this stupid Target card with the astronomical interest rate forever or is there some action that I can take over this if it is indeed them denying the transfer? Does anyone have any advice? This is just a wonderful end to a very bad week ... I will explain when I post my numbers but all I have to say is that my EF is wiped out and I had to end up putting about $200 on a card on top of the EF so my total will probably go up this month. I cant wait for Spring tomorrow maybe it will change my luck!

Gad. Gotta wonder what stopped the transfer, probably just a timing thing or something, I can't imagine Target would refuse the transfer, but they might have had something electronic going on, some automated process that glitched.
The other thing is - the new card, did they say they could send you access checks? You would have to be VERY clear on this, ok? It's not CASH, it's checks you would use to transfer the money, there's a difference, and you want to be very certain that using the checks to pay your Target bill would NOT be regarded as a CASH transaction, because CASH charges out differently. Ask them if they can send them to you, even if Target's bank can't (or won't) handle an electronic exchange, they won't refuse a check. And then you could write the check for the full amount to the new card, and you'd be zero on Target.
But before you do - I don't care if you have to repeat it 80 times, be CERTAIN they are being regarded as a 0% transfer!

kristin11 - How frustrating! What bank is the Target Card, through? It's not the same one as the new card is it? That's the only reason I could think of for the Target card not accepting the transfer. You can't do a balance transfer within the same bank. I'm sorry your having such a bad week. I hope things get better for you.

I was able to pay for putting him to sleep out of my EF which helped in keeping the CC increase down. DH and I have been cleaning out the attic and spare room and are selling some things on eBay to build the EF back up. Hopefully in a few months, it will be back up to $1000. The good news this past month was I paid off my car (non-racing debt) using our tax refund. This will free up $324 more a month which is a HUGE help. Our budget was about $125 short each month which DH somehow managed to find doing small handyman jobs plus with lots of overtime plowing this winter. Now we don't have to worry so much anymore and I feel alot less stressed over our bills. It's taken a little over a year to finally feel some freedom. ;D The rest of our tax refund was put in the bank so we can pay the car insurance in full in June rather than paying it every other month for 6 months which totally messes up the budget. So, all in all, other than my dear dog going to the Rainbow Bridge, it wasn't a bad month as I had feared. It's been a long road but we are finally the point where I feel there is a light at the end of the tunnel. While that day is still far off, the desperation of how to pay everything each month has finally lifted.

Lark - I did not receive any checks from them yet but I know that I have from Discover in the past so that would be something worth looking into with them should this transfer not go through again. Thanks for the advice!
Raven64 - The Target card is actually through Target National Bank and this new card is HSBC so as far as I know the two are not connected in any way. I just hope that they have some answers for me tomorrow should things still not have gone through! I at least hope that I would be able to transfer another one of my balances.
Thank you for the advice and hoping for some better times for us all since spring is here now! All though you wouldn't be able to tell from the snow we are getting here!

We are trying to buy one to rent. ronnyanna: This home is a Fannie Mae homepath home. We picked up this home for a steal and were approved for renovation money as well. In 2006 (the last time the home sold) the house sold for double what we bought it for. I will offer a bit of a head's up to you when purchasing a Fannie Mae foreclosed home, they want to move FAST! They will try and pressure you to move faster than your contingencies state; if you ask them to slow down and get your lawyer involved, they'll wait - being PITA's about it, but they'll wait. Get a lawyer that is very experienced in foreclosures; not all real estate lawyers are. Also, you're purchasing AS IS at contract...not at closing. So whatever happens between when you go into contract and closing is your problem - Fannie Mae wont change that. I'm not sure what state you're in, but the closing costs are higher on a foreclosure due to back taxes, additional fees, etc. (well in NY they are). We looked at a home that went into contract the day before and when we approached the home, the door was kicked in and "The Bloods" (Gang) had graffitied every wall in the (5yr old) home. We walked out. Hope all of this helps (if you didn't know it already). Do your homework and don't buy anything that you know you'll be overwhelmed with. There are a lot of options out there.

This is a little off-topic, but can anyone recommend message boards with good advice for parents of ADHD children? My son is so much like me that I've taken a lot of his ADHD issues in stride. I've also had 8 years of raising him to learn how to handle him. My fiancee is not dealing as well with things like my son's constant forgetfulness, but everything we try does not help my son remember anything any better. We are at our wits end but we can't afford and would prefer not to spend the thousands on solutions that have been barely tested so I'm hoping to find a good message board that could provide us with some coping skills and solutions that have worked for them. Any recommendations?
