Just wanted to share TLDR-- former owner played bitch games, is winning bitch prizes What had started out as awesome, headed into a nightmare-in-the-making, but hopefully will come out great still. The land (about 9 acres) was owner financed, with the agreement that I had first refusal rights on a neighboring lot. I swear I had that in writing, but could not find it anywhere. Last summer, he sold that lot out from under me. At least my new neighbor seems nice? In May, I called him to see if we could make arrangements to finally clear his crap off the property (he filled the pole barn with crap AFTER I started making payments on the property, and hasn't cleaned up as we agreed. Unfortunately, I was trusting and did not demand immediate clean up in the real estate contract. I felt completely stuck because I was still making payments to him.) Also asked for a payoff amount so I could pay off the loan. Long story short, he started playing games, refusing to talk to me until I contacted his lawyer (he would call me a couple times a day, but would not talk when I answered, pretending later that my phone just rang and rang and no one ever picked up). First thing out of his mouth when he did finally talk to me was "I don't want it paid off this year because I don't want to pay the taxes." I was willing to work with him (make all my payments for the year principal only, and I'd wait to pay it off in January). It looked like we were making progress, and then he started playing the "no talk" game again (not calling me back, picking up his phone after 2 rings and not talking, I couldn't leave a message this way, etc). So, I got my own attorney. My attorney has had a recent battle with him and his attorney, and won. Anyway, the payoff got wire transferred this morning! My attorney will send a "clean up with a license/bonded contractor or all is abandoned" letter, to his attorney, today or tomorrow. That pole barn is going to get emptied one way or another, my way will just involve a big bonfire in the future. Hopefully he won't try to keep playing games with the deed, or we'll end up in court, but my attorney is prepared for that. It took a lot of hard saving (the property price was more than my house), but I can finally move on to the next step-- cleaning up and building the house. I did have to take a loan against my retirement to come up with the full balance, but I'm ok with that (started my retirement savings when I was 21, and it's well funded). Hopefully that takes less than the 8 years paying off the property took! I felt lightheaded when I walked out of the Credit Union this morning, but now it's just like a big weight has been lifted, even though I know it's not completely over. ETA: I don't feel a bit guilty that he now has to pay the taxes this year, instead of getting to wait until next year when he would have had time to plan retirement withdrawals, etc. Even if it all ends up in the 30% bracket.

Just another reminder of why I hate dealing with people. Owner financing, leases with options, all that creative stuff I did in the beginning because I had to. Oh, the joy of dealing with big nameless faceless corporations!

After ignoring me for almost a month, I did receive a call today from an "unavailable" number. I'm 99.9% sure it's the former owner (I have not received "unavailable" calls from anyone but him in many years). I missed the call, and he did not leave a message, but I'm taking that as verification that the wire transfer went through okay!
If anyone ever does an owner financed deal, I highly recommend going through an escrow company for payments. That alone would have saved me from much of the headache involving paying off the property and getting the deed.
My attorney is not in the office much this week, so not sure when I'll hear back from him, but hopefully that end all goes as planned. If former owner calls again, I'll explain he needs to have his lawyer call my lawyer...

We only did one owner finance and we were the owner. It was also only for $10k. But it took that guy years to pay it off. He finally did this year, I was THRILLED. We wanted rid of it, it was just a thorn in my side. We have a lot to get rid of in Texas, but its rented to someone with our old 80's mobile home on it. We sold the mobile years ago but where are they going to go with that thing? I just want the money out of it, its by Frisco, Texas worth about $50k now and paying $1100 taxes on just the lot. I finally raised her rent $50 a month and she had a fit. She is paying hardly anything, the houses rent for $1500 a month and up, so the woman has a deal. I offered her the lot couple years ago and she didn't take us up on it, I told her now the price has raised so not messing with it. I will have to give them several months notice to give her time to move it. Hubs said we might just offer them a couple thousand for it so they can move and just sell it with that on it and let the new owners deal with it. I'm sure the neighbors will be thrilled for these trailers on this corner lot to go. A lot of the lots which are 1/3 an acre are being sold and very nice homes are being built on them. it's like a slum in the middle of new $300k and up houses. This will be our final piece to get rid of in Texas.

It wasn't an owner finance but when we bought this house I had to keep bugging the former owner to get their piano, grandfather clock and stuff out of the house and the mower out of the only little shed here. I said we are hauling stuff up here from Texas and need all the room. they kept claiming in Indiana they had 30 days to get it out. In a cash sale?? I never heard of that. I thought they were never going to move it. She paid some piano mover probably more then the piano was worth to move it and the clock too. Will never do that again if we move again.

My husband bought two pianos from the ReStore for $50 to salvage the ivory from the keys. They are so hard to move that once they have a few they won't accept any more as donations until the ones that they have are sold.
