I was speaking in general terms, from Obama's executive order amnesty to Obamacare to Gay marriage. It all reeks of "making policy" without the consent of the duly elected representatives of congress. I thought the Affordable Care Act WAS passed by Congress? It was... however The SCOTUS has repeatedly ignored parts that are unconstitutional in favor of keeping it "propped up". In essence, legislating from the bench by NOT doing anything, when SOMETHING was required.

Off topic, but I wanted to give a shout out and thank you to the mods. We've had a lot of contentious and divisive issues of late and I wanted to thank the mods for volunteering their time and keeping us in line.
And I'd also like to thank those who participated. Thanks for keeping it civil and courteous.

Off topic, but I wanted to give a shout out and thank you to the mods. Sorry Richard but the only ones who judge if legislation is or is not unconstitutional is the nine people in black robes who are called SCOTUS.....no matter how you and I feel about a ruling....way the cookie crumbles...

Sorry Richard but the only ones who judge if legislation is or is not unconstitutional is the nine people in black robes who are called SCOTUS.....no matter how you and I feel about a ruling....way the cookie crumbles... Incorrect. Anyone can "judge" something as Unconstitutional (especially when it is, and anyone that can read should know it)... only SCOTUS can reverse it as law based on that. They failed in their job when it comes to Obamacare.

Obamacare isn't the only time they've screwed up a ruling. It's just the most recent, so it's fresh in everyone's mind.

We are just playing on words here...we can have a opinion..call it judging if you want but there is no authority to change or over ride the SCOTUS decisions unless ...and I am not a legal scholar so this is a opinion only..the legislature passes a law and that law can still be appealed in court all the way up to the SCOTUS...if felt the law is illegal or UNCONSTITUTIONAL....and if it is accepted by them , that court..then they would rule on that..Thats their job...responsibility Lets face it..on all decisions..there will always be some one unhappy with their decision....why we have a court ..to settle those disagreements...Always getr a kick out of the arguments put up so many times..."That is unconstitutionaal yadda, yadda.."

I agree... only the 9 Justices have the power to override a law. And I agree that there will always be people unhappy because their side lost. This isn't "unhappy because my side lost" though... this is "confused as hell because there was absolutely ZERO basis, according to the Constitution, for their side to win!" And it may be a lot of "yadda yadda"... but that doesn't change the fact that it's true. The two big Obamacare decisions that were crap were the illegal fine which Congress has no authority to levy, and the most recent one about subsidies allowed on the federal exchange in clear violation of the actual law, as written, itself.
