And another chapter in "As Bonny's Real Estate Sale Turns";
Buyer showed up unannounced at the house. DH called out to him and asked if he was "Mister X". Buyer said yes. DH asked him why he was at the house. Buyer said to meet his Termite guy. DH said "And you haven't called our agent to make an appt? Buyer says "I don't have to" Claimed he didn't know he had to make an appt with our agent. DH said "You are a licensee, you know the rules. Please leave my property".
Buyer was a little pissy but left.
He subsequently wrote a syrupy sweet e-mail to our agent but how he was in the area and just dropped by to see if anyone was working on his (emphasis added!) house but was confronted by an angry man who claimed to be the owner. And he was sorry if he caused any problems.
Buyers then signed the last amendment accepting revised Termite Report and repairs by our termite company. They actually won't be completed and clearance issued until noon on Monday.
I'm so glad DH was there. What would have been better is if DH had been a little more patient and let the buyer use the key he illegally made and then confronted him red-handed.
And FWIW, I called the local police department to find out what we should do if he shows up again. I really want a third party there as a witness in case the buyer goes off again. And I don't trust DH to keep a cool head. They said if the guy doesn't leave then DH should call for assistance and they will dispatch an officer to help calm things down.
Agent's manager thinks buyer will stop "visiting" now that he knows DH is there. Hopefully this will be the end of it. I'm headed to a remote part of the Sierras starting tomorrow to packpack in area which likely has no cell or internet coverage. I won't know what happens until Friday when my girlfriend and I hike out. I signed a power of attorney for DH just in case something else comes up.

Like WTF! - now they want to make sure that it is in the contract the small blinds are staying. Hello!!! They are custom blinds.... They are all staying!
- then they never made their offer contingent on the house appraising and now they want to! Lawyer said it is not worth fighting them on it because one way or another they would try to weasel their way out of it. So we agreed!
Now can you get moving already!

I am ready to smack my buyers!!! One moment they have no lawyers and are perfectly ok with it, now they have a lawyer and want to change a million and 10 things!! Like WTF! - now they want to make sure that it is in the contract the small blinds are staying. Hello!!! They are custom blinds.... They are all staying! - then they never made their offer contingent on the house appraising and now they want to! Lawyer said it is not worth fighting them on it because one way or another they would try to weasel their way out of it. So we agreed! Now can you get moving already! First time buyers who don't understand anything? It's a little late now to go back and change the offer. My parents sold their house to a first time buyer who didn't understand much. Their only contingency was the financing. House was built in 1920. Should have had contingency for inspection. It was never brought up and my parents were never told if one happened. No way did that house not have problems.

If they have a financing contingency, it's really the same thing. Remember the house you two were buying that didn't appraise? If they can't bring the additional money to the table themselves, then the financing won't go through. Potatoes, poTAhtoes.

House closed last Monday, July 18th and we were on record at 5:30pm. Got a text on my nifty Delorme communicator from DH at our base camp in the Eastern Sierras at 9,200'. Technology can be really cool.
I didn't get home until last Sunday night at 6pm and then spent all day at a memorial service for DH's aunt. MIL is here through tomorrow. Didn't want to deal with turning on my computer or my e-mails until this morning.
Our next steps are deciding about filing a formal complaint against the buyer with the California Bureau of Real Estate. We will have some further discussions with our real estate agent and her manager this week along with our lawyer.

Okay, I do get the question about the blinds. I know it seems silly, but the first house I bought the sellers took all the blinds, all the curtain rods, and all the curtains. All of which is standard to convey. I had to fight for weeks to get some of the curtain rods back. I never did any of the blinds back. So this time I made sure it stated that the blinds were staying. Because I had been burned previously on that very issue.

My goals are two-fold with the complaint. First, no one should have to go through what we did. This guy abused his privilege as a licensee (we actually checked to see if there were previous disciplinary actions against him or his broker before entering into the sale with him and there weren't any). As a former licensee I'm appalled at what he did. No one should go through what we did and we were better prepared than most sellers. I wouldn't be seeking any monetary damages with the complaint. I think we are contractually obligated to go through the mediation/arbitration process.
Secondly, we all (DH, our atty and me) are convinced that this guy will find something wrong with the house as part of his remodeling project and claim we hid or covered it up. As previously described in this thread, DH found dirty hand prints around the electrical box and he also found the sewer clean-out caps loosened. It's obvious that he was having additional inspections done but not notifying us. We think it was done deliberately so he wouldn't have to notify us of any findings and so he could leave the door open for additional claims.
By filing the complaint I believe that any subsequent action by him will appear retaliatory and make him look even worse in front of the mediation/arbitration folks which will be handled through the Bureau of Real Estate. Our atty has been pushing us to find an excuse to go to mediation/arbitration because at the end of the process the buyer agrees to release us for ALL claims and cannot come back at us for any future claims.
I don't like doing business this way but sometimes you got to fight a bully by being even tougher than he is.

Bonny, I hadn't realized all that. It's a shame you have to go through that but it's understandable, given your explanations. I hope it's relatively quick and painless, and that after that, your life gets a bit easier!

Welcome home, Bonny - I missed you! How was the hike and how were the Sierras?
I would recommend mend filing a complaint against him because actions were so far from being acceptable. He damaged the house, had a key made and all of the other problems he created. Also, if it would serve to indemnify you against future claims, then definitely go for it.
ETA - any interesting update on your MIL?

We told them they can have the patio set and the washer/dryer: how much are they are offering? Everything else is a no! We had plan on leaving the washer/dryer behind since it would not fit in any of the homes we have seen but they don't know that . Let's see how much they offer and me just laugh my ass off!

It's too bad you can track down who did the electrical inspection and possible the other inspections. They should be able to tell you what days the inspections where done and they might be willing to cooperate if they realized that they were on the property without permission because of this other guy. Then you would have your solid proof that not only did he enter the property without permission that he also had an unauthorized key. Good luck to you.

I would sell as much as you can. Patio set definitely. Washer and dryer also.
My dryer died a month before we moved. I wanted to wait to buy a new one. Some house had washer dryer already. We ended up buying one. The house we moved to didn't have washer or dryer, but I probably would have bought a gas dryer. So now I have a brand new electric dryer that will last a while

I think just the washer and dryer cost us about 2k Depends on what kind of washer, dryer and patio set. If that washer/dryer come with extended warrantees I'd be willing to pay extra. Maybe ask $1500? Either way it will save you the trouble and expense of moving it all.

I would definitely be filing a complaint. I don't have the real estate knowledge you do and would like to know if a buyer who is also a licensed realtor has done stuff like this. Also suspicious about what else he has in mind.

This isn't unusual for buyer's to ask if personal property is available for sale. What's cheeky is if they include it in their offer to purchase.
Especially nowadays so much furniture is used for staging and will be sold.
Take it as a compliment; your wife has great taste and looks like the house has been furnished by a designer.
FWIW, we acquired a dining set from the owner of our AZ home 13 years ago. I really liked the table and thought it would look great at our cabin. But the sellers wanted $600 and that was outside of my budget. I thanked them kindly and let them know the circumstances.
When DH came to the house after closing they left the dining table set for us.
They were kind sellers.

ETA - any interesting update on your MIL? The Sierras were wonderful; it's absolutely otherworldly at 10,500' elevation. Beautiful lakes and forests as far as the eye could see. We/I did 3 passes at just under 12,000'.
In hindsight I pushed my girlfriend too hard on the hike in. We overnighted at 9,200' and did a 8.5 mile hike up and over a nearly 12,000' pass. She had issues with the elevation and the next day her back started spasaming. We kept our camp where it was and did a day hike; about 4 miles for her and 8 miles for me. I wanted us to do as much higher elevation hiking as we could since neither of us live at elevation. The next day she surprised me by pushing us to hike further; we wound up hiking out that day on a kick-butt 9.5 mile up and over the first pass. Weather was perfect while we were in the mountains with highs in the mid 70s and lows in the mid 40s. Driving out and down to the little town of Independence, CA (pop 669) was a reality shock. It was 104 degrees at 4pm. Supposedly the high that day was 110.
MIL flew in Thursday and has been driving DH nuts since. I had driven from the Sierras to San Diego so I could do the walk-through with my new tenant in my mom's condo. Poor me I only have had to deal with her on Monday for the funeral and yesterday. She's going home this afternoon.

Carl, you are one cool dude. ...... yep, sell the washer, dryer, and anything else that won't fit in your new home. Getting new laundry stuff is the newest technology ..... but I would ask $1500 and maybe come down to $1250 for everything.
Your DW does have good decorator taste .... mine is terrible and our home looks like it.

Bonny, many, many years my g-g aunt Dot was the curator of the little museum in that town. Did you do any site seeing while there. As I remember it's a very peaceful town that absolutely hates Los Angeles and what that city did to the water system there. LA is taking all they can get.

Parents left their very old washer, dryer and freezer in the house they sold because the grandsons didn't want to carry them out of the basement.
I was surprised sellers didn't ask to have them removed.

The only sight-seeing I did before or after our hike was to go down to Manzanar on Monday, July 18th. I've wanted to see that since reading "Farewell to Manzanar" in school.
I did read a little tourist magazine about some of the buildings in Independence. They looked really cool and there is some interesting history for that little town. But we were totally beat after hiking out and 110 degrees is a little warm for just walking around town. I joked with my girlfriend that she should feel right at home; probably the same temp as Cave Creek! One funny thing was when she left on Monday to meet me at the campsite it was raining buckets when she left home. I really thought we might run into some monsoonal rains up there in the mountains. But she said the rain stopped just about the AZ-CA border. We really lucked out!
